ORDINANCE NO. 88-9-4118
AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION RESPECTING THE PROPOSED PLANNED UNIT DEVELOPMENT OF
1\. THE PADUCAH MEDICAL MALL LOCATED ON LONE OAK ROAD, SOUTH OF HIGHLAND
BOULEVARD, AND ACCEPTING THE DEDICATION OF THE PUBLIC RIGHTS-OF-WAY AND
EASEMENTS AND SETTING BOND AMOUNT
WHEREAS, the Paducah Planning Commission, at a meeting held
on April 4, 1988, adopted a preliminary report, a plat of the Planned
Unit Development of the Paducah Medical Mall, located on the Lone Oak
Road, south of Highland Boulevard, and by Resolution dated August 15,
1988, recommended to the Board of Commissioners of the City of Paducah,
Kentucky, the adoption of an ordinance approving the final plat of said
medical mall reflected thereon, and accepting the dedication of the
public rights-of-way and easements shown thereon, and
WHEREAS, pursuant to Section 12(2) (b) the City Engineer has
recommended that a performance bond or an approved letter of credit in
the amount of $135,000.00 for Phase I be posted by Purchase Medical
Realty Corporation c/o Surgical Group for construction of streets,
storm drainage systems, sanitary sewers, water lines, monuments, and
other designated public improvements,
KENTUCKY:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
SECTION 1. That a resolution adopted by the Paducah Planning
Commission on August 15, 1988, entitled "A RESOLUTION CONSTITUTING THE
FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED PLANNED
UNIT DEVELOPMENT OF THE PADUCAH MEDICAL MALL LOCATED ON THE LONE OAK
ROAD, SOUTH OF HIGHLAND BOULEVARD", be approved as the final report of
said Commission respecting the matters set forth therein.
SECTION 2. That the subdivision of said property shall be,

and it is hereby, approved as shown on the plat referred to in said
subdivision, which plat is entitled "Paducah Medical Mall", and said
property is hereby declared to be subdivided as shown on said plat.
SECTION 3. That the dedication of the public rights-of-way
and public utility easements shown on said plat shall be, and they are
hereby, accepted but such acceptance shall not constitute an under-

taking on the part of this Board or the City of Paducah, Kentucky, for
the construction, improving or maintaining of said right=of-way, that
being a matter for separate consideration and action. The Mayor is

hereby authorized to subscribe a certificate of approval on the plat.
SECTION 4. That pursuant to Section 12(2) (B) of the Paducah
Subdivision Ordinance, a performance bond or an approved letter of
credit in the amount of $135,000.00 for Phase I, with approved
corporate surety, and running to the City of Paducah, is set and that
said bond or letter of credit shall be in such form and containing such
contents that meet the approval of the City Engineer and the Corpora-
tion Counsel of the City of Paducah.
SECTION 5. That if any section, paragraph or provision of
this ordinance shall be found to be inoperative, ineffective or invalid
for any cause, the deficiency or invalidity of such section, paragraph
or provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this ordinance to make each
and every section, paragraph and provision hereof separable from all
other sections, paragraphs and provisions.
SECTION 6. This ordinance shall be read on two separate days
and will be effective upon publication of title and a certified summary
thereof.
