HomeMy WebLinkAbout88-10-4130» ­_­..... , -.,j,',- .,. ._... , -.. , 4 - I _ •.I __ :.T:' :. tl 4 1J191},d !l ^,L Jv LLjd IJ...I—h ebNll1�— I In ORDINANCE NO. 88-10-4130 AN ORDINANCE CREATING SECTION 12-41 AND AMENDING SECTIONS 12-46 AND 12-49, OF CHAPTER 12, FIRE PREVENTION AND PROTECTION, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY WHEREAS, KRS 95.440 required members of the Fire -' Department reside in McCracken County; and WHEREAS KRS 95.440 was amended by the Kentucky State Legislature to allow the City Commission to decide issues to residency requirements of firefighters; and WHEREAS, the Board of Commissioners feels that the citizens of the City of Paducah are better served if members of the Fire Department reside within McCracken County. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 12-41, Residency Re- quirements for Firefighters, is hereby created to read as follows: "All members of the Fire Department hired after October 1, 1988, shall remain residents of McCracken County, Kentucky, as a condition of their continued employment within the Fire Department of the City of Paducah." SECTION 2. That Sec. 12-46, Qualifications of Trainees, is hereby amended to read as follows: "No person shall be employed as an applicant -can- didate for employment as a fireman in the fire department who does not possess the following qualifications and comply with the following requirements: 11(1) They must be able to read, write and under- stand the English language and must be a high school graduate or hold a certificate of high school equivalence issued on the basis of a successful completion of the General Educational Development Test administered and approved under the supervision of the United States Armed Forces Institute, or a recog- nized institute of higher learning, or the Commonwealth of Kentucky. " (2 ) They must be a least nineteen (19) years of age and must not have reached their thirty-eighth (38th) birthday. 439 11(3) They must be a person of sobriety and integ- rity who at all times has been an orderly law-abiding citizen." 11(4) They must be able to identify the colors of red, green and yellow. 11(5) They must have standard visual acuity - without correction, not less than 20/40 in one eye, and 20/100 in the other eye; and with correction, not less than 20/20 in one eye, and 20/40 in the other eye. 11(6) They must have a valid driver's license." SECTION 3. That Sec. 12-49, Appointees; proba- tionary period; disciplinary actions, is hereby amended to read as follows: "(a) All appointments to the fire department shall be for an initial probationary period of 040 six months. During the six months'probationary period, the candidate shall be an appointee to the fire department, not a member as the term is used in KRS 95.450. No appointee shall be deemed a member of the fire department until such time as the appointee has satisfactorily served the OAOIWAMIi OVNOAtt/XU0X19143W six months' probationary period. At such time as the appointee may have successfully completed six months of service, he shall become a permanent employee of the fire department and, therefore, a member of the fire department entitled to the procedures of KRS 95.450. "(b) Until the six months' probationary period has elapsed, the appointment shall be conditional. As such, the appointee shall not be entitled to the discipline procedures of KRS 95.450. At any time during the appointee's probationary period, he may be summarily removed by the 440 board of commissioners of the City of Paducah. SECTION 4. This ordinance shall be read on two separate days and will become effective upon publication of title and a certified summary thereof. GERRY B.
