ORDINANCE NO. 93-12-50':;6'Z
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT WITH PADUCAH & LOUISVILLE RAILWAY, INC. FOR
CONSTRUCTION AND MAINTENANCE OF A SANITARY SEWER ACROSS,
ALONG, AND UNDERNEATH PROPERTY OWNED BY THE PADUCAH &
LOUISVILLE RAILWAY, INC. IN CONJUNCTION WITH THE COLEMAN ROAD
PROJECT
WHEREAS, the City of Paducah is constructing
sanitary sewer service in conjunction with the Coleman Road
project; and
WHEREAS, Paducah & Louisville, Inc., has granted
permission for the City to construct and maintain the proposed
sanitary sewer across, along, and underneath property owned by
Paducah & Louisville Railway, Inc.
WHEREAS, the parties have reached a mutual agreement
for this project.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:

SECTION 1. The Mayor is hereby authorized to
execute an Agreement with Paducah & Louisville Railway, Inc.
for construction and maintenance of a sanitary sewer across,
along, and underneath property owned by Paducah & Louisville
Railway, Inc. in conjunction with the Coleman Road Project.
This agreement is attached hereto and incorporated by
reference as if fully set out herein.
SECTION 2. In consideration of a preparation and
handling fee of this agreement, the City of Paducah agrees to
pay the Paducah & Louisville Railway, Inc. $200. This
expenditure shall be charged to Account No. 40-33-05-464.
SECTION 3. An emergency is declared to exist due to

the fact that the Coleman Road project is under construction
and delay of execution of this agreement will cause temporary
suspension of the sanitary sewer construction. Therefore,
this ordinance shall have one reading and become effective
upon passage. A summary of this ordinance shall be published
pursuant to KRS Chapter 424.
