HomeMy WebLinkAbout94-4-5096HE ORDINANCE NO. 94-4- S-096 AN ORDINANCE RATIFYING AND APPROVING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY AND COMMONWEALTH OF KENTUCKY TRANSPORTATION CABINET, DEPARTMENT OF HIGHWAYS FOR THE RELOCATION OF KENTUCKY AVENUE BETWEEN 23RD STREET AND 28TH STREET WHEREAS, the City and the Commonwealth of Kentucky Transportation Cabinet, Department of Highways entered into an agreement dated January 28, 1994, for the relocation of Kentucky Avenue between 23rd Street and 28th Street; and WHEREAS, as required by law the aforesaid contract must be ratified and approved by ordinance. NOW, THEREFORE BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Board of Commissioners of the City of Paducah, Kentucky, hereby ratifies and approves the execution of an agreement dated January 28, 1994, between the City and the Commonwealth of Kentucky Transportation Cabinet, Department of Highways for the relocation of Kentucky Avenue between 23rd Street and 28th Street. A copy of this agreement is attached hereto and incorporated by reference as if fully set out herein. SECTION 2. Pursuant to KRS 83A.080, the City Commission suspends the requirement of a second reading of this ordinance. As grounds therefor, the City Commission does hereby declare an emergency to exist as to the execution of the agreement. Specifically, any delay in the execution of the aforesaid agreement could adversely impact the development of expansion improvements and facilities to be located at the Western Baptist site.
