HomeMy WebLinkAbout94-6-5135497 ORDINANCE NO. 94-6-5135 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF WEST PARK VILLAGE APARTMENTS, PHASE II, LOCATED AT THE INTERSECTION OF HANSEN ROAD AND WEST PARK DRIVE, AC- CEPTING THE DEDICATION OF PUBLIC EASEMENTS AND SETTING BOND AMOUNT WHEREAS, the Paducah Planning Commission, at a meeting held on June 6, 1994, adopted as a preliminary report a plat of the proposed subdivision of property of Brooks Proper- ties (West Park Village Apartments, Phase II), and by Resolu- tion dated June 6, 1994, recommended to the Board of Commis- sioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision re- flected thereon, and accepting the dedication of the public easements shown thereon; and WHEREAS, the City Engineer has recommended an escrow agreement in lieu of a bond, adopted by Municipal Order No. in the amount of $140,000.00, for construction of streets, storm drainage systems, sanitary sewers, water lines, monuments, and other designated public improvements. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on June 6, 1994, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMIS- SION ON THE PROPOSED SUBDIVISION OF PROPERTY OF BROOKS PROPER- TIES INC LOCATED AT THE INTERSECTION OF HANSEN ROAD AND WEST PARK DRIVE", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "West Park Village Apartments, Phase II", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public rights- of-way and public utility easements shown on said plat shall be, and they are hereby, accepted, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the construction, improving or maintaining of said right-of-way, that being a matter for separate consideration and action. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That if any section, paragraph or provi- sion of this ordinance shall be found to be inoperative, inef- fective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 6. This ordinance shall be read on two separate days and will become effective upon summary publica- tion pursuant to KRS Chapter 424.
