HomeMy WebLinkAbout94-6-5132492 ORDINANCE NO. 94-6-_6j,3.;2_ AN 4 -6 -_6j,3.;2 -- AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF GARRISON PROPERTIES (WESTWOOD ESTATES) LOCATED AT THE INTERSECTION OF NORTH 36TH STREET AND THE BRANCH, AC- CEPTING THE DEDICATION OF PUBLIC EASEMENTS AND SETTING BOND ` AMOUNT WHEREAS, the Paducah Planning Commission, at a meeting held on May 16, 1994, adopted as a preliminary report a plat of the proposed subdivision of property of Westwood Estates, and by Resolution dated May 16, 1994, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of the public easements shown thereon; and WHEREAS, pursuant to Section 12(2)(b) the City Engineer has recommended that a performance bond or an approved letter of credit by a bank licensed to conduct business in the State of Kentucky in the amount of $5,000.00 for replacing, back -filling or reconstructing openings made in streets, side- walks, grass plots, alleys or other public ways, and other designated public improvements. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on May 16, 1994, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMIS- SION ON THE PROPOSED SUBDIVISION OF PROPERTY OF GARRISON PROPER- TIES LOCATED AT THE INTERSECTION OF NORTH 36TH STREET AND THE BRANCH", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "West- wood Estates", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public rights- of-way and public utility easements shown on said plat shall be, and they are hereby, accepted, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the construction, improving or maintaining of said right-of-way, that being a matter for separate consideration and action. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That pursuant to Section 12(2)(B) of the Paducah Subdivision Ordinance, a performance bond or an 493 approved letter of credit by a bank licensed to conduct busi- ness in the State of Kentucky in the amount of $5,000.00, with approved corporate surety, and running to the City of Paducah, is set and that said bond or letter of credit shall be in such form and containing such contents that meet the approval of the City Engineer and the Corporation Counsel of the City of Paducah. SECTION 5. That if any section, paragraph or provi- sion of this ordinance shall be found to be inoperative, inef- fective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 6. This ordinance shall be read on two separate days and will become effective upon summary publica- tion pursuant to KRS Chapter 424.
