HomeMy WebLinkAbout94-11-5227ORDINANCE NO. 94-11-5227 AN ORDINANCE GRANTING PADUCAH WATER WORKS A PERPETUAL UTILITY EASEMENT ON CITY PROPERTY KNOWN AS THE GRAMSE PARCEL WHEREAS, Paducah Water Works has requested from the City of Paducah a certain permanent utility easement across a parcel of real property owned by the City which is necessary to erect, construct, install and lay and thereafter use, operate, inspect, repair, maintain, replace and remove a water line, with all rights in ingress, egress and regress over and across said real property. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY SECTION 1. That the City of Paducah does hereby authorize and direct the Mayor to execute a permanent and perpetual easement across a parcel of real property owned by the City of Paducah, which easement is necessary to erect, construct, install and lay, and thereafter use, operate, inspect, repair, maintain, replace and remove a water line, with all rights in ingress, egress and regress over and across said real property, for the use and benefit of Paducah water Works. Said easement is more particularly described as follows: Starting at an iron pin on the northeast property corner of the Grantor's tract, said iron pin being the southeast property corner of the Legeay tract; thence south 16 degrees 37 minutes 16 seconds west a distance of 130.27 feet to the point of beginning; thence south 16 degrees 37 minutes 16 seconds along the east line of the Grantor's parcel a distance of 15.03 feet; thence north 69 degrees, 54 minutes 52 seconds a distance of 2173.15 feet to the east right of way of Legeay Lane; thence north 21 degrees 35 minutes 16 seconds along the east right of way of Legeay Lane a distance of 15 feet to a point; thence south 69 degrees 54 minutes 53 seconds a distance of 2171.86 feet to the point of beginning. The above described parcel contains 0.748 acres (32,585 sq. ft.). SECTION 2. That the Corporation Counsel of the City of Paducah, Kentucky, is hereby authorized, empowered and directed to prepare for the Mayor's signature an easement from the City of Paducah, Kentucky, to Paducah Water Works the aforesaid perpetual easement, and any and all documents necessary to effectuate this transfer. SECTION 3. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: t Clerk MN M.
