HomeMy WebLinkAbout95-1-5239128 ORDINANCE NO. 95-1-sa3i AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF COMPUTER SERVICES, INC., FOR COMPUTER SERVICES, INC, PROPERTIES PHASE II LOCATED ON FRIEDMAN LANE, ACCEPTING THE DEDICATION OF PUBLIC RIGHTS-OF-WAY AND EASEMENTS AND SETTING BOND AMOUNT WHEREAS, the Paducah Planning Commission, at a meeting held on August 15, 1994, adopted as a preliminary report a plat of the proposed subdivision of property of Computer Services, Inc., and by Resolution dated September 19, 1994, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of the public rights-of-way and easements shown thereon; and WHEREAS, pursuant to Section 12(2)(b) the City Engineer has recommended that an escrow agreement in lieu of a bond approved by a bank licensed to conduct business in the State of Kentucky in the amount of $106,000 for completion of the roadway, sanitary sewer and other matters. ll BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: Y SECTION 1. That a resolution adopted by the Paducah Planning Commission on September 19, 1994, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF COMPUTER SERVICES, INC., FOR COMPUTER SERVICES, INC, PROPERTIES PHASE II SUBDIVISION LOCATED ON FRIEDMAN LANE", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "Computer Services Inc., Properties Phase II Subdivision", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public mr rights-of-way and public utility easements shown on said plat shall be, and they are hereby, accepted, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the construction, improving or maintaining of said right-of-way, that being a matter for separate consideration and action. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. 129 SECTION 4. That pursuant to Section 12(2)(B) of the Paducah Subdivision Ordinance, an Escrow Agreement in lieu of a bond approved by a bank licensed to conduct business in the State of Kentucky in the amount of $106,000.00, with approved corporate surety, and running to the City of Paducah, is set and that said escrow agreement shall be in such form and containing such contents that meet the approval of the City Engineer and the Corporation Counsel of the City of Paducah. SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 6. Pursuant to KRS 83.060, the City Commission suspends the requirements of a second reading of this ordinance by declaring an emergency to exist, to -wit: The expeditious enactment of this ordinance will facilitate the closing of a constrution loan for the purpose of the immediate development of a multi-million dollar commercial complex within the city's corporate limits. This ordinance shall become effective upon the first reading and publication as required by law.
