ORDINANCE NO. 95-7- S3 ZC
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY,
GRANTOR, AND CROUNSE CORPORATION AND INGRAM BARGE COMPANY,
GRANTEES, FOR ENCROACHMENTS UPON CITY RIGHT-OF-WAY
WHEREAS, Grantee, Crounse Corporation, is the owner
of certain real property located at 101 Washington Street which
property is currently under lease to Grantee, Ingram Barge
Company; and
WHEREAS, Grantees have an existing commercial
structure encroaching upon a portion of City floodwall
right-of-way at the above location; and
WHEREAS, Grantees have requested from the City of
Paducah permission to use a portion of City floodwall right-of-
way at the above location to improve existing an structure,
which will cause further encroachment upon said right-of-way;
and
WHEREAS, Grantees have previously obtained all
necessary permits and approvals from the City Floodwall
Superintendent and the District Engineer of the United States
Engineering Department, as required by Section 13-7 of the
Paducah Code of Ordinances; and
WHEREAS, the City is desirous of permitting the
aforesaid encroachment, which is insignificant in nature,
to remain on a permanent and perpetual basis in that same will
be beneficial to the City and its citizens.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY
SECTION 1. The Mayor is hereby authorized to enter
into an Encroachment Agreement with Crounse Corporation and
Ingram Barge Company for improvements to an existing structure
on City floodwall right-of-way in the vicinity of Washington
and First Street. This encroachment area shall contain 0.0101
acres or 441.8 square feet.
SECTION 2. This ordinance shall be read on two
separate days and will become effective upon summary publica-
tion pursuant to KRS Chapter
