HomeMy WebLinkAbout95-9-5360323 ORDINANCE NO. 95-9- 5 �d AN ORDINANCE AMENDING SECTION 40.17 AND CREATING SECTION 40.24, OF APPENDIX A - ZONING, OF THE PADUCAH ZONING ORDINANCE N BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 40.17 of Appendix A - Zoning, of the Paducah Zoning Ordinance, is hereby amended to read as follows: "Section 40.17 Screening Requirements - The necessity of screening and the type of screening required varies greatly with each particular situation; therefore, it is the intent of this section to provide a discretionary measure in deciding the appropriate height, width and type of screening necessary: 40.171 Required Areas - Screening shall be required and adequately maintained in the following situations: (a) Where a business zone abuts a residential zone, a screen will be required along the boundary of the business property adjacent to the residential [property). (b) Where an industrial zone abuts a residential zone, a screen will be required along the boundary of the industrial property adjacent to the residential [property]. (c) Where on M lot or portion thereof automobiles appliances and their component parts that are under repair or reduction, a screen shall be required. (e)(d) Off-street parking lots shall be screened when located adjacent to or in a residential zone. (Mobile home parks shall provide a screen along their property lines as required by Section 40.145. (e)(DLFences in a residential zone, which may be placed along a boundary, for the purpose of providing privacy or security to the resident shall follow the following height limitations: (1) Front Yard 4 feet (2) Side Yard 6 feet (3) Rear Yard 8 feet For the purpose of this section fence shall be interpreted to include any We of fence, wall trellis or structure placed for the purpose of this section." 40.172. Procedure: The procedure to determine screening height, type and width as follows: (a) The developer shall submit his plat to the planning and zoning administrator and city engineer and shall show the type of screening to be located along the boundary of his property. miagambim"W" ._ .� ..,­ I' 324 SECTION 2. That Section 40.24, of Appendix A - Zoning, of the Paducah Zoning Ordinance, is hereby created and ordained to read as follows: "40.24 Gamine and Gamblin Facilities 40.241 For the purpose of this section a Gaming or Gamblin facility is one that operates as its principal use bettinggames- or games of chance for prizes These include but are not limited to bingo arlors horse tracks coin o erated electronic or mechanical devices and card ames 40.242 No principal permitted use for gamin or gambling as set forth in 40.241 may operate within 200 feet of any residential district." SECTION 3. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
