AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY,
AND GEORGE G. SIRK, JR. AND WIFE, LANA SIRK, FOR AN ENCROACHMENT UPON
~~ ~~ AN ALLEY ADJACENT TO 260 VALLEY ROAD
WHEREAS, George G. Sirk, Jr. and wife, Lana Sirk, are the owners of a
residence located at 260 Valley Road, situated in McCracken County, Paducah, Kentucky; and
WHEREAS, the City of Paducah, Kentucky, is the owner in fee simple of a
portion of residential land located adjacent to an unimproved 20' alley, situated in McCracken
County, Paducah, Kentucky; and
WHEREAS, George G. Sirk, Jr. and wife, Lana Sirk were allowed to encroach on
said alley previously approved by the Board of Commissioners on June 10, 1986, by Ordinance
No. 86-6-2852, which allowed a fence to be constructed in the alley for an approximate width of
4' and distance of 60'; and
WHEREAS, George G. Sirk, Jr. and wife, Lana Sirk, are desirous of encroaching
upon and utilizing a portion of the previously approved encroachment area for construction of a
garage within the alley for an approved width of 4' and distance of 40'; and
WHEREAS, the City of Paducah, Kentucky, is desirous of permitting the aforesaid
~~~ encroachment by George G. Sirk, Jr. and wife, Lana Sirk, in accordance to the conditions set
forth herein; and
WHEREAS, the City of Paducah, Kentucky, and George G. Sirk, Jr. and wife,
Lana Sirk have now entered into an agreement pertaining to the foregoing and do desire that same
be set forth in writing and be made part of the public records of the City of Paducah, Kentucky,
and recorded in the office of the of the McCracken County Clerk.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to enter into an Encroachment
Agreement with George G. Sirk, Jr. and wife, Lana Sirk, for the utilization of a 4' X 60' portion
of a 20' alley for the construction of a garage adjacent to 260 Valley Road, which will encroach
upon and utilize a portion of said alley.
SECTION 2. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
