HomeMy WebLinkAbout95-10-5394366 ORDINANCE NO.95-10 -S3 "-~- AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE AND PRELIlVIINARY DEVELOPMENT PLAN FOR WAREHOUSE INC., ANDS & J DEVELOPMENT LOCATED AT OLIVET CHURCH ROAD, FROM R-1, LOW DENSITY RESIDENTIAL ZONE TO B-3, '°'~'~ NDING THE PADUCAH ZONING ORDINANCE GENERAL BUSINESS ZONE, AND AME SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on July 17, 1995, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE AND PRELIlVIINARY DEVELOPMENT PLAN FOR WAREHOUSE INC ANDS & J DEVELOPMENT LOCATED AT OLIVET CHURCH ROAD," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of property located on the east side of '; Olivet Church Road be, and it is hereby, changed from R-1, Low Density Residential Zone to B- 3, General Business Zone, and being more particularly described as follows: Beginning at a point 25' east at right angles from the centerline of Olivet Church Road, said centerline point being located 1043.93' south with said centerline from the centerline intersection of Olivet Church Road and ICG Railroad track; thence south 17° 54 minutes 44 seconds west for a distance of 426.00' with the east line of Olivet Church Road to a point 25' east at right angles from the centerline of Olivet Church Road; thence south 79° 56 minutes 44 seconds east for a distance of 929.00' with the north line of property described in Deed Book 471, Page 74 and Deed Book 772, Page 337 generally along an existing fence to a point; thence south 17° 54 minutes 44 seconds west for a distance of 541.00' with the east line of property described in Deed Book 772, Page 337 generally along an existing fence to a point; thence north 79° 56 minutes 44 seconds west for a distance of 519.94' with the south line of said property and the south line of the property described in Deed Book 511, Page 345 to a point; thence south 17° 47 minutes 06 seconds west for a distance of 120.00' with the ~,. east line of the property described in Deed Book 655, Page 12 to a point; thence north 79° 56 minutes 44 seconds west for a distance of 400.00' with the south line of said property to a point 25' east at right angles from the centerline of Olivet Church Road; thence south 17° 47 minutes 06 seconds west for a distance of 30.12' with the east line of said road to a point 25' east at right angles from the centerline; thence south 79° 59 minutes 58 seconds east for a distance of 1386.75' with the north line of property described in Deed Book 479, Page 209 and Deed Book 628, Page 663 to a point; thence north 10° 00 minutes 02 seconds east for a distance of 147.45' with the west line of said property to a point; thence south 79° 367 56 minutes 44 seconds east for a distance of 1069.52' with the north line of said property generally along an existing fence to a point; thence north 18° 30 minutes 39 seconds east for a distance of 227.89' with the west line of said property generally along an existing fence to a point; thence north 17° 40 minutes 30 seconds east for a distance of 854.11' with the west line of said property generally along an existing fence to a point; thence north 79° 56 minutes 56 seconds west for a distance of 2058.85' with the south line of property described in Deed Book 808, Page 250, Deed Book 704, Page 827, Deed Book 671, Page 358 and Deed Book I` 361, Page 410 generally along an existing fence to a point; thence south 17° 54 minutes 44 seconds west for a distance of 85.00' with the east line of property described in Deed Book 737, Page 638 to a point; thence north 79° 56 minutes 56 seconds west for a distance of 185.00' feet with the south line of said property to a point; thence south 17° 54 minutes 44 seconds west for a distance of 30.00' with the east line of said property to a point; thence north 79° 56 minutes 56 seconds west for a distance of 200.00' with the south line of said property to the point of beginning. Together with and subject to covenants, easements, and restrictions of record. Said property contains 51.4621 acres more or less. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
