HomeMy WebLinkAbout95-10-5393364 ORDINANCE NO. 95-10- ~g~ AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF WAREHOUSE INC. FOR FACII,ITIES LOCATED ON OLIVET CHURCH ROAD, ACCEPTING THE DEDICATION OF STREETS AND PUBLIC EASEMENTS AND SETTING BOND AMOUNT WHEREAS, the Paducah Planning Commission, at a meeting held on September 18, 1995, adopted as a preliminary report a plat of the proposed subdivision of property of Warehouse, Inc., for facilities located on Olivet Church Road, and by Resolution dated October 16, 1995, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of the public easements shown thereon; and WHEREAS, the City Engineer has recommended an escrow agreement in lieu of a bond, adopted by Municipal Order No. in the amount of $514,107.50, for construction of streets, storm drainage systems, sanitary sewers and other designated public improvements. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on October 16, 1995, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF WAREHOUSE INC. FOR SUBDIVISION OF PROPERTY AND DEDICATION OF STREETS AND FACILITIES LOCATED ON OLIVET CHURCH ROAD", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "Warehouse Inc. Property", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public rights-of--way and public utility ~. easements shown on said plat shall be, and they are hereby, accepted and shall be maintained by the City of Paducah, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the construction or improvements of said right-of- way. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That an escrow agreement in lieu of a bond, adopted by Municipal Order No. in the amount of $514,107.50, is set and that said escrow agreement shall be in such form and containing such contents that meet the approval of the City Engineer and the Corporation Counsel of the City of Paducah. SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make - ,._,rm:~ ~,-~ -.:.-: ~-,~ ...,..~„ ~ ~.~... ,~-r:r--gym,- x-T~ ...-~--n...,.. ~ »,..,. ,. _ ..«..,~:,-ra i ,,.~._,......... ,_. 365 each and every section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 6. This ordinance shall be read on two separate days and will become effective upon publication pursuant to KR5 Chapter 424.
