ORDINANCE NO. 95-10- S3~o,-
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT BY AND BETWEEN THE CITY OF PADUCAH AND LARRY AND
SHIRLEY LAX FOR IMPROVEMENTS TO REAL PROPERTY OWNED BY LAX AND
LOCATED ON THE COLEMAN ROAD NEAR THE COLEMAN INDUSTRIAL PARK
WHEREAS, Lax owns a tract of real property located on
~;' Coleman Road near Coleman Industrial Park, upon which property
is located a residential dwelling; and
WHEREAS, the City has made recent improvements to
Coleman Road at or about the site of the Lax property; and
WHEREAS, it is the contention of Lax that these
improvements have caused damage to his real property by reason
that the improvements have caused a greater surface water flow
upon his property; and
WHEREAS, the City has offered to take certain
remedial measures which would alleviate certain problems
associated with the flow of surface water; and
WHEREAS, the parties have come to an agreement
regarding the foregoing and do now desire to formalize their
agreement in writing.
BE ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized to
~, execute an Agreement by and between the City of Paducah and
~~ Larry and Shirley Lax for improvements to real property owned
by Lax on the Coleman Road near the Coleman Industrial Park.
SECTION 2. This ordinance shall be read on two
separate days and will become effective upon summary
publication pursuant to KRS Chapter 424.
