AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY,
AND THE COUNTY OF MCCRACKEN, FOR AN ENCROACHMENT UPON A RIGHT OF
WAY OF CLARK STREET
WHEREAS, the County of McCracken is the owner of a block of land, between
6th and 7th Streets and Washington and Clark Streets, situated in McCracken County, Paducah,
Kentucky; and
WHEREAS, the City of Paducah is the owner in fee simple of a portion of Clark
Street, between 6th and 7th Streets, located adjacent to the County of McCracken's property,
situated in McCracken County, Paducah, Kentucky; and
WHEREAS, the County of McCracken is desirous of encroaching upon and
utilizing a portion of the right of way of Clark Street, between 6th and 7th Streets; and
WHEREAS, the City of Paducah is desirous of permitting the aforesaid
encroachment by the County of McCracken, in that it will be beneficial to the citizens of the City
of Paducah, Kentucky; and
WHEREAS, the City of Paducah, Kentucky, and County of McCracken desire to
enter into an agreement pertaining to the foregoing and do desire that same be set forth in writing
and be made a part of the public records of the City of Paducah, Kentucky, and recorded in the
office of the County Court Clerk of McCracken County, Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to enter into an Encroachment
Agreement with the County of McCracken, for the encroachment and utilization of the right of
way of Clark Street, between 6th and 7th Streets.
SECTION 2. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
