AN ORDINANCE AUTHORIZING AND
APPROVING SETTLEMENT AND EXPENDITURES
IN FURTHERANCE OF SETTLEMENT
REGARDING CITY OF PADUCAH, ET AL V. JAMES
W. RHODES, ET AL, COURT OF APPEALS
DOCKET NO. 95 -CA -2274
WHEREAS, City of Paducah, et al, is party to litigation styled City
of Paducah, et al v. James W. Rhodes, et al, Commonwealth of Kentucky, Court of
Appeals, Docket No. 95 -CA -2274; and
WHEREAS, the parties to the referenced litigation have
satisfactorily resolved all issues in controversy between them; and
WHEREAS, the City of Paducah desires to approve and authorize
settlement of the above litigation;
NOW THEREFORE, BE IT ORDAINED BY THE CITY OF
01 PADUCAH, KENTUCKY:
Section 1. The City Commission hereby authorizes and approves
settlement of the above -referenced litigation and payment to the following
individuals in the amounts hereinafter set forth in furtherance of said settlement:
James W. Rhodes $6,916.00
David Feezor $7,974.00
Don Henry $1,861.00
James W. Owens Chartered $3,200.00
Section 2. Payment to the above individuals and/or entities shall be
made in full and final satisfaction of all claims which were or could have been
asserted against the City of Paducah in the above -referenced matter and
V contingent upon execution of a release in favor the City of Paducah in a form
acceptable to its Corporation Counsel.
Section 3. The City Commission does hereby direct the Finance
Director of the City of Paducah, Kentucky, to effectuate the aforesaid
expenditures and same shall be charged to Account No.
566
Section 4. This ordinance shall be read on two separate days and
will become effective upon summary publication pursuant to KRS Chapter 424.
