HomeMy WebLinkAbout96-6-5500572 ORDINANCE NO. 96-6- 56-06 AN ORDINANCE AUTHORIZING THE INSTITUTION OF LEGAL PROCEEDINGS ON BEHALF OF THE ELECTRIC PLANT BOARD OF THE CITY OF PADUCAH, D/B/A PADUCAH POWER SYSTEM, TO ACQUIRE BY CONDEM- NATION THE ELECTRIC PLANT AND FACILITIES OF JACKSON PURCHASE ELECTRIC COOPERATIVE CORPORATION LYING WITHIN THE MUNICIPAL BOUNDARIES OF THE CITY OF PADUCAH, KENTUCKY WHEREAS, the Electric Plant Board of the City of Paducah, d/b/a Paducah Power System (hereinafter "Paducah Power"), has adopted a resolution requesting that the City of Paducah institute condemnation proceedings on its behalf for the purpose of acquiring by condemnation the electric plant and facilities of Jackson Purchase Cooperative Corporation (hereinafter "Jackson Purchase") lying within the municipal boundaries of the City of Paducah, Kentucky; and WHEREAS, by ordinance adopted July 12, 1994, the Board of Commissioners of the City of Paducah, Kentucky, indicated its desire that Paducah Power acquire by condemnation the hereinabove described plant and facilities of Jackson Purchase; and WHEREAS, on November 8, 1994, a majority of the qualified voters of the City of Paducah approved Paducah Power's acquisition by condemnation of the electric plant and facilities located in all areas of the City not being served by Paducah Power. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City agrees with the hereinabove described resolution by Paducah Power System and hereby directs its designated attorney to initiate condemnation proceedings on behalf of Paducah Power System to acquire the electric plant and facilities of Jackson Purchase Electric Cooperative Corporation lying within the municipal boundaries of the City of Paducah, Kentucky. SECTION 2. Paducah Power System may join in the condemnation petition as a co -petitioner. SECTION 3. All costs involved in the condemnation shall be borne by the Paducah Power System. SECTION 4. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
