HomeMy WebLinkAbout96-7-5525614 ORDINANCE NO. 96-7- 5x5-2 S' AN ORDINANCE PROVIDING FOR THE CLOSING OF A PORTION OF 26TH STREET LOCATED BETWEEN BROADWAY AND WASHINGTON STREET BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: r SECTION 1. That the City of Paducah does hereby authorize closing a portion of L�11 26th Street located between Broadway and Washington Street, and being more particularly described as follows: Beginning at the point of intersection of the centerline of 26th Street and the centerline of old Kentucky Avenue (as closed by the City of Paducah Ordinance No. 93-12-5051), said centerline intersection being located north 62°45'38" east a distance of 459.55 feet from the intersection of the centerline of Kentucky Avenue and the centerline of 27th Street; thence, from the point of beginning and with the centerline of the said closed Kentucky Avenue, north 62°45'38" east a distance of 30.00 feet to a point; thence, south 27'20'14" east a distance of 193.64 feet to the point of intersection of the east right of way line of 26th Street and the north right of way line of a 25 foot wide alley through Block 22; thence, continuing south 27'20'14" east a distance of 25.00 feet to the point of intersection of the said 26th Street right of way and the south right of way line of the said alley; thence, continuing south 27'20'14" east a distance of 118.88 feet to a point; thence, south 62°39'46" west a distance of 60.00 feet to a point in the west right of way line of 26th Street; thence, north 27'20'14" west a distance of 352.47 feet to a point in the centerline of the aforementioned closed Kentucky Avenue; thence, north 62'45'3 8" centerline of the aforementioned closed Kentucky Avenue; thence, north 62°25'38" east a distance of 30.00 feet back to the point of beginning. The above described parcel of land in right of way contains a total of 0.4560 acres. SECTION 2. In support of its decision to close the aforesaid public way, the Board of Commissioners hereby makes the following findings of fact: a. Baptist Healthcare System, Inc., are the owners of property abutting the public way which the Board of Commissioners has authorized to be closed as is evidenced by the application for street and/or alley closing which is attached hereto and made part hereof. b. On the 6th day of May, 1996, the Paducah Planning Commission of the City of Paducah adopted a resolution recommending to the Mayor and Board of Commissioners of the City of Paducah closure of the aforesaid public way. C. Written notice of the proposed closing was given to all property owners in or abutting the public way or the portion thereof being closed as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. d. All property owners in or abutting the public way or the portion thereof being closed have given their written notarized consent to the closing as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. 615 SECTION 3. All requirements of KRS 82.405(1) and (2) having been met, the Board of Commissioners of the City of Paducah hereby concludes that the aforesaid public way, as described above, should be closed in accordance with the provisions of KRS 82.405. SECTION 4. The Mayor is hereby authorized, empowered, and directed to execute a quitclaim deed from the City of Paducah to each of the property owners in or abutting the public way to be closed with each to acquire title to that portion of the public way contiguous to the property now owned by said property owners up to center line of the said public way. Provided, however, that the City shall reserve such easements upon the above described real property as it deems necessary. Said deed shall provide the reservation by the City of Paducah any easements affecting the herein described real property as described in Section 1 above. SECTION 5. This ordinance shall be read on two separate days and become effective upon publication of title and certified summary thereof.
