AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY,
AND JOE SHANE, FOR AN ENCROACHMENT UPON CITY OF PADUCAH
FLOODWALL RIGHT OF WAY LOCATED ADJACENT TO 3360 WAYNE SULLIVAN
DRIVE
WHEREAS, Joe Shane, is the owner of a driving range known as Southside
Driving Range, located at 3360 Wayne Sullivan Drive, situated in McCracken County, Paducah,
Kentucky; and
WHEREAS, the City of Paducah, Kentucky, is the owner in fee simple of a
portion of land located adjacent to a floodwall, situated in McCracken County, Paducah,
Kentucky; and
WHEREAS, Joe Shane is desirous of encroaching upon and utilizing a portion of
the right of way adjacent to the floodwall; and
WHEREAS, the City of Paducah, Kentucky, is desirous of permitting the aforesaid
encroachment by Joe Shane, in that it will be beneficial to the citizens of the City of Paducah,
Kentucky; and
WHEREAS, the City of Paducah, Kentucky, and Joe Shane, have now entered

be made part of the public records of the City of Paducah Kentucky, and recorded in the office of
the of the McCracken County Clerk.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to enter into an Encroachment
Agreement with Joe Shane, for the utilization of a golf safety net to be located forty (40) feet
from the centerline of the floodwall and also being located adjacent to the driving range located at
3360 Wayne Sullivan Drive.
SECTION 2. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
