HomeMy WebLinkAbout96-9-5570715 ORDINANCE NO. 96-9-5570 ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO TIE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, a tract of property adjacent to the present city limits, located at lot #49 of Bellview Subdivision (West Park Village, Phase III), is urban in character and suitable for development for urban purposes without unreasonable delay; and WHEREAS, the property is contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter, described property, and WHEREAS, said tract of land is not within the boundary of another incorporated city; and WHEREAS, KRS 81A.412 permits final annexation if prior written consent is obtained from each owner of the land to be annexed; and WHEREAS, the owners have requested such annexation in writing to the Mayor and Board of Commissioners of the City of Paducah. BE IT ORDAINED BY TIE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to finalize the annexation of the hereinafter described property, and therefore that the hereinafter described property be annexed to, and be made a part of the City of Paducah, Kentucky; said real property being more particularly and accurately described as follows: Beginning at a 1/2 inch steel rod and cap at the Southwesterly corner of Lot Number 49 of the Bellview Subdivision, the plat of said subdivision being of record in Plat Section' F", page 7 of the McCracken County Court Clerk's Office; Thence S. 85 degrees 21' 21" E. along and with the southerly line of said lot 145.83 feet to the point of intersection with the northwesterly right-of-way line of Relocated Holt Road, said point being located on the arc of a curve that is concave to the northwest with said curve being non -tangent to the preceding boundary line along the aforesaid Lot Number 49; Thence along and with the northwesterly right-of-way line of Relocated Holt Road and the arc of a curve having a radius length of 649.07 feet, a chord length of 178.33 feet with a bearing on the chord of S. 37 degrees 23' 06" W; a distance of 178.90 feet to the point of intersection with the northernly line of Lot Number 47; thence N 85 degrees 21' 21"W a distance of 49.38 feet to a 1/2 inch steel rod and I. cap at the northwesterly comer of said lot; Thence N. 04 degrees 38' 39" E. , 150.00 feet to the point of beginning and containing 15,374 square feet or 0.353 acres and being subject to all easements, restrictions, and covenants of public record. The bearings cited in these descriptions are based upon a bearing of N. 71 degrees 03' 34" E. along the center line of Relocated U.S. Highway 60 as shown by highway right-of-way plans. The aforesaid property contains 15,374 square feet or 0.353 acres. 716 SECTION 2. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
