That the City of Paducah does hereby authorize closing State Street and being more particularly described as follows: DESCRIPTION OF STATE STREET FORMERLY PARK STREET, TO BE CLOSED AND VACATED BEING A FIFTY FOOT WIDE UNIMPROVED RIGHT-OF-WAY KNOWN AS STATE STREET, FORMERLY KNOWN AS PARK STREET, LOCATED IN THE WILLOW - WOOD ADDITION NO.2 TO THE CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY, THE PLAT OF SAID ADDITION BEING RECORDED IN PLAT BOOK "B", PAGE 17 OF THE McCRACKEN COUNTY COURT CLERK'S OFFICE, THE PORTION OF SAID STREET TO BE CLOSED AND VACATED BEING BOUNDED BY THE WESTERLY RIGHT-OF-WAY LINE OF BLOOM AVENUE AND THE EASTERLY RIGHT-OF-WAY LINE OF THE P AND L RAILROAD, FORMERLY THE ILLINOIS CENTRAL RAILROAD, THE NORTHERLY LINES OF BLOCKS 2, 5 AND 6 OF THE AFORESAID ADDITION AND THE SOUTHERLY LINES OF BLOCKS 3,4 AND 7 OF SAID ADDITION, SAID RIGHT-OF-WAY BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING WHERE THE WESTERLY RIGHT-OF-WAY LINE OF BLOOM AVENUE INTERSECTS THE SOUTHERLY RIGHT-OF-WAY LINE OF STATE STREET, SAID POINT BEING AT THE NORTH- EASTERLY CORNER OF LOT NO. 1, BLOCK NO.2 OF THE AFORE- SAID ADDITION; THENCE IN A WESTERLY DIRECTION ALONG AND WITH SAID SOUTHERLY RIGHT-OF-WAY LINE AND PROJECTIONS THEREOF AND WITH THE NORTHERLY LINES OF BLOCKS 2,5 AND 6 OF SAID ADDITION, 996.00 FEET TO THE EASTERLY RIGHT- OF-WAY LINE OF THE P AND L RAILROAD AT THE NORTH- WESTERLY CORNER OF LOT NO. 7, BLOCK NO.6 OF SAID ADDITION; THENCE IN A NORTHEASTERLY DIRECTION ALONG AND WITH SAID EASTERLY RIGHT-OF-WAY LINE WITH AN ANGLE OF 340-41' TURNED COUNTERCLOCKWISE FROM THE AFORESAID SOUTHERLY RIGHT-OF-WAY LINE, 87.86 FEET TO THE SOUTH- WESTERLY CORNER OF BLOCK NO.7 OF SAID ADDITION; THENCE IN AN EASTERLY DIRECTION ALONG AND WITH THE NORTHERLY RIGHT-OF-WAY LINE OF SAID STREET AND PROJECTIONS THEREOF, WITH THE SOUTHERLY LINES OF BLOCKS 7,4 AND 3 OF SAID ADDITION AND WITH AN ANGLE OF 145°-19' TURNED COUNTERCLOCKWISE FROM THE AFORESAID EASTERLY RIGHT-OF-WAY LINE, 923.77 FEET TO THE POINT OF INTERSECTION WITH THE WESTERLY RIGHT-OF-WAY LINE OF BLOOM AVENUE AT THE SOUTHEASTERLY CORNER OF LOT NO. 1, BLOCK NO. 1 OF THE ADDITION AFORESAID; THENCE IN A SOUTHERLY DIRECTION WITH AN ANGLE OF 90°-00' TURNED COUNTERCLOCKWISE FROM THE AFORESAID NORTHERLY RIGHT-OF-WAY LINE 50.00 FEET TO THE POINT OF BEGINNING AND FORMING AN ANGLE OF 90°-00' AS TURNED FROM SAID CLOSING LINE TO THE AFORESAID SOUTHERLY RIGHT-OF-WAY LINE OF SAID STREET AND CONTAINING 47,994 SQUARE FEET ti OR 1.102 ACRES. SECTION 8. In support of its decision to close the aforesaid public way, the Board of Commissioners hereby makes the following findings of fact: a. J. Thomas Garrett, Wade Edwards, and Carolyn A. Jody, are the owners of property abutting the public way which the Board of Commissioners has authorized to be closed as is evidenced by the application for street and/or alley closing which is attached hereto and made part hereof. b. On the 5th day of August, 1996, the Paducah Planning Commission of the City of Paducah adopted a resolution recommending to the Mayor and Board of Commissioners of the City of Paducah closure of the aforesaid public way. C. Written notice of the proposed closing was given to all property owners in or abutting the public way or the portion thereof being closed as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. d. All property owners in or abutting the public way or the portion thereof being closed have given their written notarized consent to the closing as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. SECTION 9. All requirements of KRS 82.405(1) and (2) having been met, the Board of Commissioners of the City of Paducah hereby concludes that the aforesaid public way, as described above, should be closed in accordance with the provisions of KRS 82.405. SECTION 10. The Mayor is hereby authorized, empowered, and directed to execute a quitclaim deed from the City of Paducah to each of the property owners in or abutting the public way to be closed with each to acquire title to that portion of the public way contiguous to the property now owned by said property owners up to center line of the said public way. Provided, however, that the City shall reserve such easements upon the above described real property as it deems necessary. Said deed shall provide the reservation by the City of Paducah any easements affecting the herein described real property as described in Section 1 above. SECTION 11. This ordinance shall be read on two separate days and become effective upon publication of title and certified summary thereof.
