AN ORDINANCE RATIFYING AND APPROVING
SETTLEMENT OF THE LITIGATION STYLED "CITY OF
PADUCAH, KENTUCKY V. CHARLES W. TAYLOR, ROBERT
A. ROBBINS, LARRY H JOHNSON, MCCRACKEN CIRCUIT
0'; COURT, CIVIL ACTION NO. 96 -CI -00746.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY,
WHEREAS, the City of Paducah, Kentucky, has filed a civil
action against Charles W. Taylor, Robert A. Robbins, and Larry H. Johnson,
McCracken Circuit Court, Division II, Civil Action No. 96 -CI -00746, for
the collection of the outstanding balance due on a promissory note
executed and negotiated by the defendants to the City of Paducah in the
principal amount of $80,000.00 on September 30, 1983; and
WHEREAS, the City of Paducah and debtors have reach a
settlement and compromise of the aforesaid collection proceedings,
whereby the City of Paducah, Kentucky, shall receive the sum of $40,000.00
in full and final satisfaction and payment of the aforementioned
promissory note dated September 30, 1983, in the principal amount of
$80,000.00; and
of $40,000.00.
WHEREAS, the City does hereby acknowledge receipt of the sum
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION I. The City Commission hereby approves and ratifies
all actions of the Mayor, Hon. Albert Jones, or the City Manager, Jerry
Hoover, heretofore made in noting on the aforesaid promissory note payment
in full and releasing note to Hon. John T. Reed, for and on behalf of
Charles W. Taylor, Robert A. Robbins, and Larry H. Johnson.
SECTION H. The City Commission further hereby approves and
ratifies the execution of an agreed order of dismissal of the aforesaid
civil action brought by the City of Paducah, Kentucky, against the
defendants, Charles W. Taylor, Robert A. Robbins, and Larry H. Johnson, by
the Mayor, Hon. Albert Jones, or the City Manager, Jerry Hoover.
SECTION III. This ordinance shall be read on two separate days
and become effective upon summary publication pursuant to KRS Chapter 424.
