HomeMy WebLinkAbout97-3-5650ORDINANCE NO. 97-03-_5�so AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY, AND MOSS ROSE CAFE FOR AN ENCROACHMENT UPON CITY RIGHT-OF-WAY WHEREAS, Moss Rose Cafe is the owner of certain real property located at 119 South 2nd Street in Paducah, McCracken County, Kentucky; and WHEREAS, Moss Rose Cafe has requested from the City of Paducah permission to use portions of City right-of-way for the purpose of (1) providing a fire escape exit located in the south right-of-way of an alley adjacent to the north side of the Cafe, and (2) for placement of two planters on a portion of the sidewalk at the front entrance of the Cafe, which encroachments are insignificant in nature. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY SECTION 1. That the Mayor is hereby authorized and directed to enter into an Encroachment Agreement with Moss Rose Cafe for (1) location of a fire escape exit in the south right-of-way of an alley adjacent to the north side of the Cafe, and (2) for placement of two planters on a portion of the sidewalk at the front entrance of the Cafe,,which encroachments shall be pursuant to the terms and conditions C contained in an Encroachment Agreement to be executed by and between the parties. SECTION 2. This ordinance shall read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
