HomeMy WebLinkAbout97-2-564672 ORDINANCE NO. 97-2- s� AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF STINESPRING ESTATES -PHASE B FOR HERPEL ENTERPRISES, INC., LOCATED ON HOLT ROAD, ACCEPTING THE DEDICATION OF STREETS, PUBLIC IMPROVEMENTS, PUBLIC EASEMENTS AND SEWERS WHEREAS, the Paducah Planning Commission, at a meeting held on July 12, 1989, adopted as a preliminary report a plat of the proposed subdivision of property of Stinespring Estates for Herpel Enterprises, Inc., located on Holt Road; and WHEREAS, the City of Paducah adopted Ordinance No. 91-12-4702 on December 10, 1991, approving the final plat of Stinespring Estates -Phase A; and WHEREAS, by Resolution dated February 5, 1996, the Paducah Planning Commission recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of Stinespring Estates -Phase B reflected thereon, and accepting the dedication of streets, public easements, storm drainage systems, sanitary sewers and other designated public improvements; and WHEREAS, the City Engineer by letter dated February 10, 1997, stated that all requirements had been completed in accordance with the subdivision plan and the City's specifications and hereby recommends the acceptance of the aforesaid subdivision plat. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on February 5, 1996, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF HERPEL ENTERPRISES, INC., FOR STINESPRING ESTATES LOCATED ON HOLT ROAD", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "Stinespring Estates", dated January 1996 and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public rights-of-way and public utility ff easements shown on said plat shall be, and they are hereby, accepted and shall be maintained by the Ci f City o Paducah. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That the City of Paducah hereby approves and accepts for maintenance all streets, sanitary sewers, storm sewers and public easements with a guarantee period from the developer to expire on February 10, 1998. SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 6. This ordinance shall be read on two separate days and will become effective upon publication pursuant to KRS Chapter 424.
