AN ORDINANCE AUTHORIZING AND DIRECTING THE
MAYOR TO EXECUTE A SETTLEMENT AGREEMENT AND
ANY ANCILLARY AGREEMENTS BETWEEN THE CITY OF
PADUCAH, THE KENTUCKY OAKS MALL COMPANY AND
WAREHOUSE, INC.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized and
�. directed to execute a Settlement Agreement and Release of Certain
Claims between the City of Paducah, the Kentucky Oaks Mall Company
and Warehouse, Inc., terminating litigation relating to the East
Mall Access Road.
SECTION 2. That the Mayor is further authorized to
negotiate and execute any ancillary supplemental agreements to the
Settlement Agreement, provided that said ancillary agreements do
not materially affect the obligations or liability, if any,
incurred by the City in the Settlement Agreement.
SECTION 3. In order to adopt this ordinance before the
scheduled litigation date of February 21, 1997, an emergency is
hereby declared to exist and this ordinance shall become effective
immediately with one reading.
