AN ORDINANCE AMENDING SECTION 32, CURB, GUTTER AND
SIDEWALK REPLACEMENT AGREEMENT OF CHAPTER 98, STREETS, SIDEWALKS
AND OTHER PUBLIC PLACES OF THE CODE OF ORDINANCES OF THE CITY OF
PADUCAH,KENTUCKY
~ BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:

SECTION 1. That Section 32, Curb, Gutter and Sidewalk Replacement
Agreement, is hereby amended to read as follows:
"Sec. 98-32. Curb, C •"^-' ^•"' sSidewalk Replacement Agreement.
(a) In order to encourage and support the integrity of the existing
infrastructure facilities within the city right-of-way, the city will provide assistance to the property
owner in the reconstruction of "r.- sidewalks. This reconstruction work shall
commence upon execution of an agreement between the City Engineer and the property owner
wherein the city shall be responsible for the actual construction work necessary to replace and/or
repair •• bs, geae,.s a "F- sidewalks and the adjoining property owner shall be responsible for the
purchase of the concrete required to perform the required work.
(b) The purpose of this assistance by the city shall be to replace existing

responsibility of the property owner. The City Engineer shall be the sole judge as to which euFbs,
ga4ers er sidewalks are in need of replacement and/or repair under this replacement program.
(c) The City Engineer shall be the interpreter of this article, and any questions
or unusual circumstances which might arise regarding this article shall be resolved by the City
Engineer.
SECTION 2. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
