HomeMy WebLinkAbout98-1-5809402 ORDINANCE NO. 98-1-5809 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED AT 5200 HINKLEVILLE ROAD, FROM R-1, LOW DENSITY RESIDENTIAL ZONING, TO HBD, HIGHWAY BUSINESS DISTRICT ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on December 18, 1997, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED AT 5200 HINKLEVILLE ROAD AND OWNED BY THOMAS E. QUINNELLY," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is hereby, changed from R-1, Low Density Residential Zoning, to BBD, Highway Business District Zone, and being more particularly described as follows: Beginning at a point 32.6 feet north of the southeast intersection of Olivet Church Road & U.S. 60; thence from said point of beginning in a southerly direction 32.6 feet; thence S 6°54'32" W a distance of 278.7 feet; thence S 25°00'21" W a distance of 230.4'; thence S 45°15'08" W a distance of 304.2 feet; thence S 30'35'19" W a distance of 433.9 feet; thence west 13.2 feet to a point; thence west 50' to a point on the west right of way line of Olivet Church Road thence 36' to a point; thence S 22°48'55" W a distance of 236.6 feet; thence S 73°65'05" E a distance of 44.6 feet; thence S 30°14'04 W a distance of 152.2 feet; thence S 30°14'04" W a distance of 239.6 feet; thence N 67'1 VW a distance of 114.6 feet; thence N 16°20' W a distance of 100 feet; thence N 8°25' W a distance of 99.8 feet; thence in a northerly direction 64.7 feet; thence N 71°05'07" E a distance of 562.1' to the point of beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. 405 being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
