HomeMy WebLinkAbout98-6-5886560 ORDINANCE NO. 98-6- S-9 E� ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, a tract of property adjacent to the present city limits, located at the northeast intersectionof Olivet Church Road and U. S. 60, is urban in character and suitable for development for urban purposes without unreasonable delay; and WHEREAS, the property is contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property; and WHEREAS, said tract of land is not within the boundary of another incorporated city; and WHEREAS, KRS 81A.412 permits final annexation if prior written consent is obtained from each owner of the land to be annexed; and WHEREAS, the owners have requested such annexation in writing to the Mayor and Board of Commissioners of the City of Paducah. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to finalize the annexation of the hereinafter described property, and therefore that the hereinafter described property be annexed to, and be made a part of the City of Paducah, Kentucky; said real property being more particularly and accurately described as follows: Being a tract of land located at the northeasterly corner of the Hinkleville Road or U.S. Highway 60 at Olivet Church Road or Kentucky 998 in McCracken County, Kentucky, said tract of land presently abutting and adjoining the current corporate limits of the City of Paducah, Kentucky, and more particularly described as follows: Beginning at an existing 1/2" rebar located on the north right-of-way line of U.S. Highway 60, 83.57 feet left of highway centerline station 332+85.58 and north 72 degrees 09 minutes 35 seconds east, 85.59 feet from an existing concrete right-of- way monument located at the intersection of the east right-of-way line of relocated Olivet Church Road and the north right-of-way line of U.S. Highway 60, 85 feet left of U.S. Highway 60 centerline station 332+00, said 1/2" rebar being at the southeast corner of the property conveyed to Express Lube, Inc., of record in Deed Book 829, page 109, in the McCracken County Clerk's Office; thence leaving said right-of-way line and with the east line of said Express Lube, Inc. property, north 06 degrees 24 minutes 44 seconds west, 121.20 feet to an existing 1/2" rebar; thence continuing with the north line of said Express Lube, Inc. property, north 66 degrees 07 minutes 48 seconds west, 52.01 feet to a 1/2" rebar located on the east right-of-way line of relocated Olivet Church Road, 117.6 feet from the centerline thereof, thence leaving said Express Lube, Inc. property and along the east right-of-way line of relocated Olivet Church Road the following six calls: north 22 degrees 50 minutes 18 seconds east, 313.79 feet to an existing concrete right-of-way monument located 63.0 feet from the centerline thereof, north 38 degrees 33 minutes 13 seconds east, 71.93 feet to an existing concrete right-of-way monument located 63.4 feet from the centerline thereof, north 22 561 -1—.� ... .. ...... ..M +..� .,...4, m—,: ... ,: ... Y.„�..._. .....:_.,, degrees 23 minutes 30 seconds east, 361.69 feet to an existing concrete right-of- way monument located 45.4 feet from the centerline thereof, north 13, degrees, 22 minutes 20 seconds east, 105.95 feet to an existing concrete right-of-way monument located 28.2 feet from the centerline thereof, north 22 degrees 34 minutes 32 seconds east, 1.27 feet to a 1/2" rebar set 28.2 feet from the centerline thereof, and said rebar located at the southwest corner of the property conveyed to Charles and Virginia Hillman, of record in Deed Book 506, page 537, in the aforesaid clerk's office; thence leaving said right-of-way line and with the south line of said Hillman's property, south 76 degrees, 38 minutes, 38 seconds east, 220.00 feet to a 1/2" rebar set; thence continuing with the east line of said Hillman's property, north 22 degrees, 34 minutes 32 seconds east, 150.00 feet to a 1/2" rebar set on the south line of the Charles L. Kindred Subdivision, of record in Plat Book "G", page 93, in the aforesaid clerk's office; thence with the south line of said Kindred Subdivision, south 76 degrees, 38 minutes 38 seconds east, 900.65 feet to an existing 4" x 4" concrete monument located on the west line of the property conveyed to Kentucky Oaks Mall Company, of record in Deed Book 643, page 565, in the aforesaid clerk's office; thence with the west line of said Kentucky Oaks Mall Company property and with the west line of the property conveyed to Thomas Overstreet, of record in Deed Book 563, page 637, in the aforesaid clerk's office, and with the present corporate limits of the City of Paducah, Kentucky, south 23 degrees 02 minutes 59 seconds west, 411.79 feet to a 1/2" rebar set at the southwest corner of said Overstreet property on the northerly right-of-way line of U.S. Highway 60 at 80 feet north of the center line thereof, thence with Overstreet's southerly line and the northerly right-of-way line of said highway along the aforesaid present corporate limit line, north 80 degrees, 38 minutes 59 seconds east, a distance of 90.24 feet and north 73 degrees 25 minutes 34 seconds east a distance of 217.95 feet to the southeast corner of Overstreet's property; thence south 18 degrees 56 minutes 26 seconds east, leaving said northerly right-of-way line but continuing with the aforesaid present corporate limits, approximately 110.5 feet, more or less, to the southerly right-of-way line of said U.S. Highway 60; thence south 71 degrees 04 minutes 29 seconds west along and with said southerly right-of-way line and the aforesaid present corporate limits, approximately 1,632.0 feet, more or less, to a point; thence leaving said southerly right-of-way line and the aforesaid present corporate limits, north 18 degrees 56 minutes 26 seconds west crossing the aforesaid U.S. Highway 60, approximately 13 8. 0 feet, more or less, to the point of beginning and containing approximately 24.21 acres, more or less. SECTION 2. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
