HomeMy WebLinkAbout98-6-5885558 ORDINANCE NO. 98-6- -570"" 6 - AN ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY ANNEXING CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, a tract of property adjacent to the present city limits, located south of U. S. 60, north of Hansen Road, east of Brewer Lane and west of Buckner Lane, is urban in character and suitable for development for urban purposes without unreasonable delay; and WHEREAS, the property is contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property; and WHEREAS, said tract of land is not within the boundary of another incorporated City. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to annex the hereinafter described property, and therefore that the hereinafter described property be annexed to, and be made a part of the City of Paducah, Kentucky; said real property being more particularly and accurately described as follows: CD TRACT I: One lot in Montrose Heights No. 5 in Block No. 5 as recorded in Plat book "A" Page 123, said lot being a subdivision of the Duke William's farm and being the same property conveyed to Tully Choice by deed from Roy M. Prather and wife, Hazel R. Prather dated Jan. 6th, 1925, and recorded in Deed Book 142, Page 222 McCracken County Court Clerk's office. The above property fronting 200 feet on the Henson Road and running back for uniform width 1219 feet to Pine Street, containing 5.6 acres. Being the same property conveyed to Lee F. Powell by deed dated February 1, 1990, and recorded in Deed Book 743, Page 614, in the Office of the McCracken County Clerk. Lee F. Powell died on April 6, 1994, and his will is recorded in Will Book WW, Page 287, of the aforesaid Clerk's office. The Will of Lee F. Powell devised the above described tract of land to his widow, Dorris S. Powell, the grantor. TRACT II: Beginning at a stone on the east side of the Potter Road and at the southwest corner of the tract of land of party of the first part (J. I. Potter); running thence south 88 degrees east 2380 feet along the south line of the Potter land to a stake at the corner to General Corruthers line; running thence north 1-1 /2 degrees east 771 feet to a stake near a sycamore; thence on a new line north 86-1/2 degrees west 2430 feet to a stake on the east side of the Potter Road thence with the east side of the Potter Road south 1-1/2 degrees east 809 feet to the point of beginning, containing 43.5 acres, more or less. Beginning at a stake in the Henson Road, corner to Martin; thence with Martin's line north 2 degrees west 1219 feet to a stake, corner to Martin on the south side of a forty (40) foot road; thence with the south side of said forty (40) foot road south 87 degrees east twelve hundred and forty one (1241) feet to a stake, corner to Roy Y. There is excepted from the above described parcels a tract consisting of eight (8) acres heretofore sold to the Cornerstone Community Church and there is included herein a tract acquired by operation of law pursuant to order of the McCracken Fiscal Court closing a road. See waiver of subdivision plat of record in Plat Book "J", Page 1200, McCracken 4 County Clerk's Office. Being the same property conveyed to Lee F. Powell by Deed dated December 15, 1989, and recorded in Deed Book 735, Page 135, in the Office of the McCracken County Clerk. Lee F. Powell having died on April 6, 1994, and his will being recorded in Will Book WW, Page 287, of the aforesaid Clerk's office. The Will of Lee F. Powell devised the above-described tract of land to his widow, Dorris S. Powell, the grantor. SECTION 2. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
