AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY,
AND LONG CONCRETE INDUSTRIES INC., FOR AN ENCROACHMENT UPON CITY
OF PADUCAH RIGHT OF WAY LOCATED ADJACENT TO 1001 ESTELLE STREET
REAS Lon Concrete Industries Inc. is the owner of property located at
WHEREAS, g p P Y
1001 Estelle Street known as Long Concrete Industries, Inc., situated in McCracken County,
Paducah, Kentucky; and
WHEREAS, the City of Paducah, Kentucky, is the owner in fee simple of right of
way known as Estelle Street located adjacent 1001 Estelle Street, situated in McCracken County,
Paducah, Kentucky; and
WHEREAS, Long Concrete Industries, Inc., is desirous of encroaching upon and
utilizing a portion of the right of way of Estelle Street to construct a positive barrier (fence), and
to transport and/or stockpile masonry products; and
WHEREAS, the City of Paducah, Kentucky, is desirous of permitting the aforesaid
encroachment by Long Concrete Industries, Inc.; and
WHEREAS, the City of Paducah, Kentucky, and Long Concrete Industries, Inc.,
have now entered into an agreement pertaining to the foregoing and do desire that same be set
forth in writing and be made part of the public records of the City of Paducah, Kentucky, and
recorded in the office of the County Court Clerk of McCracken County, Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to enter into an Encroachment
Agreement with Long Concrete Industries, Inc., to construct a positive barrier (fence), and to
transport and/or stockpile masonry products within a portion of the west right of way of Estelle
Street and also being located adjacent to the Long Concrete Industries, Inc. property at 1001
Estelle Street.
SECTION 2. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
