HomeMy WebLinkAbout98-6-5869539 ORDINANCE NO. 984- Slre.'9 AN ORDINANCE PROVIDING FOR THE CLOSING OF PORTIONS OF McBRIDE LANE LOCATED SOUTH OF U.S. 60 BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize closing portions of McBride Lane located south of U.S. 60, more particularly described as follows: Tract One Commencing at the intersection of west right-of-way of McBride Lane and the south right-of-way of US Hwy. 60. Thence going away from US Hwy. 60, and following the west right-of-way of McBride Lane, along a curve, a distance of 256.58' to the point of beginning. Thence going south along a curve, an arc distance of 232.50', with a radius of 485.37 feet, and a chord distance of 230.30', following a bearing of S24°45'07'E. Thence crossing from the east right-of-way of McBride Lane to the west right-of-way of McBride Lane along a curve with a radius of 366.07', and an arc length of 100.64', and a chord distance of 100.37', and following a bearing of S 16'45'1 7"E, to a point in the west right-of-way of McBride Lane. Thence following the west right-of-way of McBride Lane along a curve with a radius of 507.46', and an arc length of 238.70', and a chord distance of 236.51' and along a bearing of N44'3 8'03'V, to a point, thence following the west right-of-way of McBride Lane, along the same curve, with a radius of 507.46', an arc length of 182.96', a chord distance of 181.97', along a bearing of N20°50'05'W, to a point. Thence along a curve with an arc distance of 92.35', and a radius of 454.01'. And a chord distance of 92.23', following a bearing of N04°43'38'W to an tangent line in the west right-of-way of McBride Lane. Thence along said tangent The aforesaid property contains 22,073 SF., 0.507 Acres. Tract Two Beginning at a point at the intersection of south right-of-way of US Hwy. 60, and the east right-of-way of McBride Line, thence following the east right-of-way of McBride Lane, N 16'52'1 O'V a distance of 33.21' to the SW corner of Drury Inns, Inc. and the NW comer of Drury Hotels Corp., Thence along said right-of- way, a distance of 25.18' and a bearing of S 16°52'26"S, to the SW corner of Drury Hotels Corp. and the NW corner of Drury Inns, Inc. Thence continuing along the same bearing of S 16052'26"E, a distance of 91.17' to a point in the right-of-way of McBride Lane. Thence going S00006'45"E a distance of 135.89' to a point in the east right-of-way of McBride Lane. Thence leaving the east right- of-way of McBride lane at an arc distance of 65.44', along a curve, with a radius a , of 413.37",- a 9hord,distance of 66.37', with a bearing of N07°08'47'W thence.along a tangent of 36.08', and a bearing of NO2°32'3 FV, to a point at the end of a curve. Thence along said curve at an arc length of 134.89', and a radius of 413.37', and a chord length of 134.29' following a bearing ofN11'46'3 8'W to a point of beginning of said curve, thence along a tangent of 43.91' and a bearing of N21 ° 14' 18'W to a point in the south right-of-way of US Hwy. 60. Thence along the east right-of-way of US Hwy 60, a distance of 10.44', along a bearing of N63°27'05"E to the east right-of-way of McBride Lane, and the point of beginning. The aforesaid property contains 525 SF., 0.012 Acres. SECTION 2. In support of its decision to close the aforesaid public way, the Board of Commissioners hereby makes the following findings of fact: a. Robert P. Meriwether, Gloria Meriwether, Robert A. Drury, Anna R. Commissioners has authorized to be closed as is evidenced by the application for dA y e11*�b tig which is attached hereto and made part hereof. b. On the 20th day of April, 1998, the Paducah Planning Commission of the City of Paducah adopted a resolution recommending to the Mayor and Board of Commissioners of the City of Paducah closure of the aforesaid public way. C. Written notice of the proposed closing was given to all property owners in or abutting the public way or the portion thereof being closed as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. d. All property owners in or abutting the public way or the portion thereof being closed have given their written notarized consent to the closing as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. SECTION 3. All requirements of KRS 82.405(1) and (2) having been met, the Board of Commissioners of the City of Paducah hereby concludes that the aforesaid public way, as described above, should be closed in accordance with the provisions of KRS 82.405. SECTION 4. The City of Paducah does hereby retain a temporary construction and access easement over the above described property until the new McBride Lane is completed and accepted by the City Engineer's Office at which time this temporary construction easement shall terminate. SECTION 5. The Mayor is hereby authorized, empowered, and directed to execute a quitclaim deed from the City of Paducah to each of the property owners in or abutting the public way to be closed with each to acquire title to that portion of the public way contiguous to the property now owned by said property owners up to center line of the said public way. Provided, however, that the City shall reserve such easements upon the above described real property as it deems necessary. Said deed shall provide the reservation by the City of Paducah any easements affecting the herein described real property as described in Section 1 above. SECTION 6. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
