RHODES, BOTH DECEASED, TO BE USED BY THE CITY OF PADUCAH, KENTUCKY TO CONSTRUCT AN 1 EXPANSION OF THE COMPOST FACILITY AND WASTEWATER TREATMENT PLANT AND AUTHORIZING THE CONDEMNATION OF SAME. 1SO$ Al. g� WHEREAS, a parcel of real property owned by the heirs of John H. Rhodes and wife, Tessie B. Rhodes, both deceased, is necessary for the construction of an expansion of the compost facility and wastewater treatment plant by the City of Paducah, Kentucky; and WHEREAS, the following described real property is needed by the City of Paducah, Kentucky, in furtherance of the public purpose of the City of Paducah to provide a compost facility and wastewater treatment plant expansion; and WHEREAS, the City of Paducah, Kentucky, has been unable to contract or agree with the owner thereof for the acquisition or purchase of the real property sought to be condemned; and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, do hereby authorize the condemnation of the herein - described real property pursuant to the Kentucky Revised Statutes; NOW, THEREFORE, be it ordained by the City of Paducah, Kentucky: SECTION 1. That the Assistant Corporate Counsel of the City of Paducah, Kentucky, be and is hereby ordered and directed to institute condemnation proceedings in the McCracken Circuit Court in the name of the City of Paducah, Kentucky, against the heirs of John H. Rhodes and wife, Tessie B. Rhodes, both deceased, and all other parties at interest to acquire the subject property owned by the aforesaid individuals. SECTION 2. That the property to be acquired is in McCracken County, Kentucky, and is more particularly described as follows: BEGINNING AT A STAKE IN THE NORTH LINE OF NORTH EIGHTH STREET 188 FEET WEST OF THE NORTHWEST CORNER OF THE INTERSECTION OF EIGHTH STREET AND TERRELL STREET; THENCE IN A NORTHERLY DIRECTION AND AT AN INTERIOR ANGLE OF 93 DEGREES AND 58 MINUTES 123.5 FEET TO A STAKE; THENCE IN A WESTERLY DIRECTION PARALLEL WITH THE NORTH LINE OF NORTH EIGHTH STREET AND AT AN INTERIOR ANGLE OF 86 �i DEGREES AND .02 MINUTES 47.08 FEET TO A STAKE; THENCE IN A SOUTHERLY DIRECTION AND AT AN INTERIOR ANGLE OF 93 DEGREES AND 58 MINUTES 123.5 FEET TO A STAKE IN THE NORTH LINE OF NORTH EIGHTH STREET; THENCE IN AN EASTERLY DIRECTION AND WITH THE NORTH LINE OF NORTH EIGHTH STREET 47.08 FEET TO THE POINT OF BEGINNING AS SHOWN BY A SURVEY PREPARED BY HARRY G. DAVI S , SURVEYOR ON JANUARY _, 1948. SECTION 3. This Ordinance shall be read on two (2) separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
