HomeMy WebLinkAbout98-12-5986135 ORDINANCE NO. 98-12- -. 104 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF DAVID L. & NADINE HAWKINS FOR ROSS INDUSTRIAL PARK LOCATED AT THE INTERSECTION OF ROSS AVENUE AND McGUIRE AVENUE, ACCEPTING THE DEDICATION OF STREETS AND PUBLIC EASEMENTS WHEREAS, the Paducah Planning Commission, at a meeting held on October 21, 1996, adopted as a preliminary report a plat of the proposed subdivision of property of David L. & Nadine Hawkins located on/at Park Avenue & McGuire Avenue, and by Resolution dated November 18, 1996, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of streets and public easements shown thereon; and WHEREAS, the City Engineer by letter dated November 30, 1998, stated that all requirements had been completed in accordance with the subdivision plan and the City's specifications and hereby recommends the acceptance of the aforesaid subdivision plat. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on November 18, 1996, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF DAVID L. & NADINE HAWKINS FOR ROSS INDUSTRIAL PARK LOCATED ON PARK AVENUE AND McGUIRE AVENUE", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "Final Subdivision Plat of Ross Industrial ", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public right-of-way and public utility easements shown on said plat shall be, and they are hereby, accepted and shall be maintained by the City of Paducah, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the construction or improvements of said right-of- way. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for an cause, the deficient or invalidity of such p � Y Y tY section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. 136 SECTION 5. In order to expedite the recording of a subdivision plat to facilitate a business development within the boundaries of the city limits by December 29, 1998, an emergency is hereby declared to exist. This ordinance shall become effective immediately with one reading.
