ORDINANCE NO. 98-12-5983
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AN AGREEMENT WITH PHIL HIGDON AND HIGDON DEVELOPMENT,
INC., FOR INSTALLATION OF THE STUART NELSON PARK ROAD- COUNTY PARK
ROAD SANITARY SEWER EXTENSION AND STUART NELSON PARK ROAD -COUNTY
PARK ROAD CONNECTOR ROADWAY
WHEREAS, Phil Higdon, is the owner of real property located between Stuart
Nelson Park Road and County Park Road, Paducah, Kentucky, as depicted on the attached plat in
which he wishes to develop (Development), and
WHEREAS, the City of Paducah is in the process of causing the installation of a
new sanitary sewer within the area of the owner's property; and
WHEREAS, Higdon has agreed under certain terms and conditions to construct a
roadway on property owned by Hidgon; and
WHEREAS, the City of Paducah has agreed under certain terms and conditions to
construct the portions of roadway required to connect Higdon's roadway to Stuart Nelson Park
Road and County Park Road;
WHEREAS, the City and Higdon desire to set their understanding forth in written
terms.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
�J SECTION 1. That the Mayor is hereby authorized and directed to execute an
Agreement with Phil Higdon and Higdon Development, Inc., for installation of the Stuart Nelson
Park Road -County Park Road Sanitary Sewer Extension and Stuart Nelson Park Road -County
Park Road Connector Roadway. This Agreement is attached hereto and incorporated by
reference as if fully set out herein.
SECTION 2. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
