ORDINANCE NO. 98 -11 -Sq J 1
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE SUPPLEMENTAL AGREEMENT NO. 1 BETWEEN THE COMMONWEALTH
OF KENTUCKY, TRANSPORTATION CABINET, DEPARTMENT OF HIGHWAYS AND
THE CITY OF PADUCAH FOR THE EAST MALL ACCESS CONNECTOR ROAD
WHEREAS, the City of Paducah and the Department of Highways, entered into an
agreement adopted by Ordinance No. 96-9-5567, wherein the Department of Highways agreed to
provide up to $250,000 for construction of a connector road known as the East Mall Access
Connector Road between U.S. 60 and Olivet Church Road at the Kentucky Oaks Mall in the City
of Paducah; and
WHEREAS, based on design engineering costs, construction low bid, construction
engineering costs and construction cost overruns, the total project cost has increased to $366,000;
and
WHEREAS, the City has requested additional funding in the amount of $116,000
for these additional project costs; and
WHEREAS, all other terms and conditions of the contract adopted by Ordinance
No. 96-9-5567, will remain the same and are legally binding; and
WHEREAS, the Department of Highways agrees to increase its financial
obligation in the amount of $116,000, for said project.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized and directed to execute
Supplemental Agreement No. 1 between the Commonwealth of Kentucky, Transportation
Cabinet, Department of Highways and the City of Paducah to obtain additional funding in the
amount of $116,000, for the construction of the East Mall Access Connector Road.
SECTION 2. Due to the fact that construction for this roadway is complete, and
the final request for payment by the contractor has been submitted, an emergency is hereby
declared to exist and this ordinance shall become effective immediately with one reading.
