ORDINANCE NO. 99-5- r0014 /
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE
DOCUMENTS TO RELEASE WAHL'S EXCAVATING AND UNDERGROUND
FROM A CONTRACT ON THE MORGAN-CORNELL ROADWAY IMPROVEMENT
PROJECT - PHASE II
WHEREAS, by Ordinance 98-5-5853 the City of Paducah approved a
contract with Wahl's Excavating & Underground for the Morgan -Cornell Roadway
Improvement Project; and
WHEREAS, by Ordinance No. 99-9-5952, the City approved Change
Order No. 1 in the amount of $59,901.58 to finalize the project and adjust actual
quantities installed; and
WHEREAS, Change Order No. 2 is required to decrease the contract
amount by $282,387.48 and to release Wahl from the remainder of their contract.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized to execute Change Order
No. 2 for a decrease in the amount of $282,387.48 with Wahl's Excavating and
Underground Inc., thereby decreasing the total contract amount to $1,080,155.60 for
work performed on the Morgan -Cornell Roadway Improvement Project - Phase II.
SECTION 2. The Mayor is further authorized to execute a Mutual
Release Agreement with Wahl's Excavating and Underground Inc. to release Wahl from
their contract on the Project in Section 1 above.

SECTION 3. This adjustment shall be applied to Account No. 40-3305-
SECTION 3. In order to provide continuity for the completion of this
project, an emergency is hereby declared to exist and this ordinance shall become effective
immediately with one reading.
