LANE PECK, AND AUTHORIZING THE TRANSFER OF SAID REAL ESTATE TO THE CITY OF PADUCAH WHEREAS Rental Housing, Inc., a Kentucky Corporation with its iP principal mailing address as Post Office Box 7744, Paducah, Kentucky, 42002-7744, and J. Lane Peck own a parcel of real estate which is adjacent to Bob Noble Park in Paducah, Kentucky; and WHEREAS, Rental Housing, Inc. and J. Lane Peck are interested in preserving the natural quality of the property; and WHEREAS, it is the intention of the City to aid Rental Housing, Inc. and J. Lane Peck in accomplishing their goals of dedicating recreational property to the City of Paducah. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City of Paducah hereby accepts the gift of real estate from Rental Housing, Inc., a Kentucky Corporation, and J. Lane Peck, of tracts of property located at 2560 Cairo Road, and being more particularly described as follows: Being a parcel of land on the south side of Old Cairo Road (Ky. Hwy. 305), in the City of Paducah, McCracken County Kentucky and being more particularly described as follows: Being Tract 1B, containing 4.115 acres, (less sewer r/w), more or less, Tract 1C containing 21.757 acres, more or less, and Tract 2, containing 15.572 acres (less sewer r/w), more or less, as shown on Waiver of Subdivision Plat for Rental Housing, Inc., Property, of record in Plat Section "U', Page 371, McCracken County Clerk's Office, to which reference is hereby made for a more complete description. Subject to permanent easement on the south side of this property in favor of the City of Paducah, Kentucky, as shown on the above plat. Being in all respects a part of the property conveyed to Rental Housing, Inc. by Deed dated March 1, 1993, of recording Deed Book 791, Page 233, McCracken County Clerk's Office. SECTION 2. It is the intention of Rental Housing, Inc., and J. Lane Peck that the property herein conveyed to the City of Paducah be dedicated to public use for park and passive recreational purposes; and that there be no ballfields or surfaces for team sports; and there be no permanent enclosed principal structures for the assembly of people on property. Further, where possible, the natural flora shall be preserved. It is not intended that vehicular access or trails be limited. The City, by acceptance of this Deed, 384 obligates itself to forever preserve and use the above-described land for this purpose and no other. SECTION 3. The Mayor is hereby authorized to execute any and all documents necessary to accomplish the purpose of transferring the above-described real estate to the City of Paducah. SECTION 4.
