AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT BETWEEN THE CITY OF PADUCAH AND McCRACKEN COUNTY,
KENTUCKY REGARDING CONSTRUCTION AND OPERATION OF A JUVENILE
DETENTION FACILITY
WHEREAS, Paducah and McCracken County have a mutual interest in
establishing a regional juvenile detention facility located in McCracken County, Kentucky;
and
WHEREAS, to promote the establishment of such a regional juvenile
detention facility, McCracken County has heretofore conveyed unto the Commonwealth
of Kentucky twenty-five acres of land located in McCracken County, Kentucky; and
WHEREAS, it was agreed that Paducah would pay unto McCracken
County a sum equal to the fair market value of said property conveyed unto the
Commonwealth of Kentucky, which value is in the amount of One Hundred Thirty
Thousand Six Hundred Thirteen Dollars ($130,613.00), the payment of which sum would
be made on a periodic basis predicated on payroll taxes.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized and directed to execute
an Agreement between the City of Paducah and McCracken County, Kentucky, whereby
the City shall pay unto McCracken County on an annual basis a sum equal to fifty percent
(50%) of all payroll taxes collected by the City which are realized directly from the actual
construction and operation of the regional juvenile detention facility. Said payments shall
continue on an annual basis until such time that McCracken County has been paid the total
of One Hundred Thirty Thousand Six Hundred Thirteen Dollars ($130,613.00).
SECTION 2. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
