HomeMy WebLinkAbout99-10-6125OR,o•��-/il-�a/a3 357 ORDINANCE NO. 99-10-��.5' AN ORDINANCE REPEALING AND RECREATING SECTION 26.34 OF CHAPTER 26, CEMETERIES, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Sec. 26.34, "Resale or transfer of lots; lot owner not to be compensated for burials", of Chapter 26, "Cemeteries", of the Code of Ordinances of the City of Paducah, is hereby repealed in its entirety and recreated and reordained to hereinafter read as follows: "Section 26.34. Sale or transfer of cemetery lots. "(a) The City Clerk of the City of Paducah shall be empowered to prepare and execute on behalf of the City of Paducah deeds conveying interest in cemetery lots in all cemeteries owned and operated by the City of Paducah, Kentucky. Deeds prepared by the City Clerk shall be effective upon the City Clerk signing said deeds on behalf of the City and without review or approval by the Office of the City Manager and the City Commission. "(b) No person shall purchase, have, hold, or own any lot or part of a lot in the cemetery for the purpose of resale, speculation, or sale of single burial places, or sell or transfer any lot or part of a lot in the cemetery. "(c) No person shall bury or suffer or permit any person to be buried on any lot or part of a lot in the cemetery owned or held by him, for a valuable consideration. "(d) No owner of a lot in the cemetery, or any part thereof, shall sell or convey a burial space for any sum in excess of the amount paid therefor when the purchase was made from the city. SECTION 2. It shall be the duty of every owner of a cemetery lot, or the owner of a part of a lot, to keep the cemetery clerk advised of his address, and upon the death of the owner, it shall be the duty of his heirs at law or devisees to file with the city clerk an affidavit of descent or a copy of the will under which such heirs at law or devisee claim title, and to furnish the cemetery clerk with a copy of such affidavit of descent or will. The city clerk shall thereupon file the affidavit of descent or will and make the proper notation upon the cemetery register, entering the names of the owners of the burial property as shown in such affidavit or will. SECTION 3. Upon the death of the owner of a lot in the cemetery, the only right which shall pass to and vest by inheritance shall be the right of the burial of the decedent's relatives. The removal of bodies or of memorials is not included in any right of inheritance." 358 SECTION 4. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
