HomeMy WebLinkAbout99-9-6118341 ORDINANCE NO. 99-9- 6 / / Y AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED AT 813, 1017, 1031, 1532 & 1534 BROWN STREET, 1024 & 1029 GREEN STREET FROM M-1, LIGHT INDUSTRIAL ZONE, TO B-3, GENERAL BUSINESS ZONE, ` AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on August 16, 1999, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR PROPERTIES LOCATED AT 813, 1017, 1031, 1532 & 1534 BROWN STREET, 1024 & 1029 GREEN STREET," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from M-1 (LIGHT INDUSTRIAL ZONE) to B-3 (GENERAL BUSINESS ZONE): Being in the Chamblin, Murray and Brown Addition to the City of Paducah, Block 13 -Lots 1, 2, 3, 11, 12; Block 8 -Lots 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15; Block 9 -Lot 13 as recorded in Plat book A page 136 and being more particularly described as follows: Beginning at a point in the center of Brown Street and Lot 3 of Block 13 extended; thence North 26 degrees 52 minutes 29 seconds East a distance of 140 feet more or less to the 331.0 contour of the C-1 zone; thence in an easterly direction along the 331.0 contour a distance of 423 feet more or less to a point in the west line of Kelly Avenue (closed); thence along the east line of Lot 15 in Block 8, South 26 degrees 52 minutes 29 seconds West a distance of 167 feet more or less to the center of a 15 feet wide alley in the center of Block 8; thence along the center of said alley, South 63 degrees 07 minutes 32 seconds East a distance of 40 feet to a point; thence along the east line of Lot 5 in Block 8, South 26 degrees 52 minutes 29 seconds West a distance of 157.50 feet to the center of Brown Street; thence along the center of Brown Street, North 63 degrees 07 minutes 32 seconds West a distance of 400.00 feet to the point of beginning containing ' 2.05 acres more or less. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. 342 SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
