HomeMy WebLinkAbout99-7-6084ORDINANCE NO. 99-7- 60 R4 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTIES LOCATED AT 1200 MURRAY AVENUE, 1397 & 1501 IRVIN COBB DRIVE, 1205-1209- 1211-1212-1213-1536 & 1538 BROWN STREET, FROM M-1, LIGHT INDUSTRIAL ZONE TO B-3, GENERAL BUSINESS ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on June 21, 1999, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR PROPERTIES LOCATED AT 1200 MURRAY AVENUE, 1397 & 1501 IRVIN COBB DRIVE, 1205-1209-1211-1212-1213-1536 & 1538 BROWN STREET," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from M-1, Ligh Industrial Zone to B-3, General Business Zone: A certain tract of land as surveyed by Ricky A. Tosh, PLS No. 2900, of the firm of Dummer Surveying & Engineering Services, Inc. of Paducah, Kentucky on May 18, 1999 located on the east side of US Highway 62 in the City of Paducah, McCracken County, Kentucky, and being more particularly described as follows: Beginning at a point in the centerline intersection of US Highway 62 (a.k.a. Irvin Cobb Drive) and Murray Avenue; THENCE South 63 degrees 07 minutes 32 seconds East for a distance of 184.99 feet with the centerline of Murray Avenue to a point in the centerline intersection of Murray Avenue and Greet Street; THENCE North 26 degrees 52 minutes 28 seconds East for a distance of 152.50 feet with the centerline of Green Street to a point; THENCE North 63 degrees 07 minutes 32 seconds West for a distance of 60.00 feet over and across the west right-of-way of Green Street and with the south line of the K. and H. Haley and T. B. Knapp property described in Deed Book 838, Page 802 [passing through a 1/2" diameter rebar with cap stamped "1645" (found) at 20.00 feet] to a 1/2" diameter rebar with cap stamped "1645 (found); THENCE North 26 degrees 52 minutes 28 seconds East for a distance of 157.50 feet with the west line of said property [passing 285 through a 1/2" diameter rebar with cap (found) at 132.50 feet][all 1/2" diameter rebars with cap are 1/2" diameter x 24" long rebar with plastic cap stamped "D. H. DUMMER PLS 1955" unless otherwise noted] to a point in the centerline of Brown Street; THENCE North 63 degrees 07 minutes 32 seconds West for a distance of 80.00 feet with the centerline of Brown Street to a point; THENCE North 26 degrees 52 minutes 28 seconds East for a distance of 150.00 feet over and across the north right-of-way of Brown Street and with the west line of the Harper Industries, Inc. property described in Deed Book 736, Page 74 [passing through a 1/2" rebar with cap (set) at 25.00 feet and passing through a 1/2" diameter x 24" long rebar with plastic cap stamped "WITNESS PT.P.L.S. 1955" (set) at 150 feet} to a point in the south line of a 15',wide alley; THENCE North 63 degrees 07 minutes 32 seconds West for a distance of 210.61 feet with the south line of said alley to a 1/2" diameter rebar with cap (set); THENCE South 83 degrees 59 minutes 46 seconds West for a distance of 40.85 feet with to a P. K. Nail (set); THENCE North 14 degrees 37 minutes 32 seconds West for a distance of 284.76 feet to a point; THENCE South 87 degrees 47 minutes 32 seconds East for a distance of 214.53 feet to a point; THENCE North 18 degrees 50 minutes 10 seconds West for a distance of 440.77 feet with the west line of the Harold Lockwood property described in Deed Book 497, Page 427 to a point; THENCE South 26 degrees 50 minutes 00 seconds West for a distance of 687.02 feet with the east line of the Paducah Joint Venture property described in Deed Book 657, Page 367, the Manilal Patel property described in Deed book 878, Page 444 with the Triple S. Inc. property described in Deed Book 805. Page 742 [passing through a 1/2" diameter x 24" long rebar with plastic cap stamped "WITNESS PT P.L.S. 1955 AT 300.20 feet and passing through a 1/2" diameter rebar with cap (set) at 650.20 feet] to a point in the centerline of US Highway 62; THENCE'South 27 degrees 44 minutes 00 seconds East for a distance of 623.98 feet with the centerline of said highway to the point of beginning. Together with and subject to covenants, easements, right-of-ways and restrictions of record and in existence. Said property contains 6.9621 acres. Note: Less and except from the above described property all that area lying below the 331 contour which is currently zoned "C -1 -The Conservancy Zone. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
