HomeMy WebLinkAbout99-3-6005157 ORDINANCE NO. 99-3-1�S AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTY LOCATED AT 3401 AND 3421 COLEMAN ROAD, FROM M-1, LIGHT INDUSTRY ZONE TO M-3, HEAVY DENSITY INDUSTRIAL ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on February 11, 1999, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR PROPERTY LOCATED AT 3401 AND 3421 COLEMAN ROAD," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification for property located at 3401 and 3421 Coleman Road is hereby changed from M-1, Light Industry Zone to M-3, Heavy Density Zone, said property being more particularly described as follows: Being a parcel of land bounded on the east by Coleman Road, on the north by the P and I Railroad right of way, on the south by the Paducah and Louisville Railroad right of way and on the west by the east right of way of Interstate 24, in the City of Paducah, McCracken County Kentucky and being more particularly described as follows: Beginning at a point at the intersection of the center of Coleman Road and the north right of way of the Paducah and Louisville Railroad, the southeast corner of the herein described tract; thence from the point of beginning, along the north right of way of the Paducah and Louisville Railroad, North 7909'24" West, 1,645.13 feet to the east right of way of Interstate 24, 0.75 feet east of an access control fence; thence along the right of way of Interstate 24, North 1202'27" West, 680.68 feet to a point; thence along the right of way of Interstate 24, North 17047' 34" West, 102.35 feet to a point; thence along the right of way of Interstate 24, North 12006'01" West, 319.36 feet to a point in the south right of way of the P and I Railroad; thence along the south right of way of the P and I Railroad along a curve to the right, having a radius of 5729.58 feet, an arc length of 633.48 feet, a chord bearing of South 65025'13" East, and a chord distance of 633.16 feet to a point; thence along the south right of way of the P and I Railroad, North 84030'19" East, 38.55 feet to a point; thence along the south right of way of the P and I Railroad, South 61034'18" East, 1,696.51 feet to a point in the center of Coleman Road; thence along the center of Coleman Road, South 30°20'51" West, 593.58 feet to the point of beginning containing 35.060 acres. Clay Robinson, P.L.S. 3219. 158 The source of title for the above described tract is Higdon Development, Inc. recorded in deed book 761 page 324, deed book 772 page 771, deed book 932 page 514, deed book 823 page 149, deed book 858 page 621. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
