APPROVAL OF MINUTES Commissioner Johnson offered the following Motion: I move that the reading of the minutes for September 11, 2023 meeting be waived and that the minutes of said meeting, prepared by the secretary, be approved as written. Commissioner Winchester provided a second. The motion passed with 4 Ayes (Winchester, Johnson, Coltharp, Jones) o Nays New Cases Case WCZC2023-0005 Applicant: Charles Nichols Address: 1404 Madison Street Request for Certificate of Zoning Compliance Planning Staff presented the staff report. Commissioner Coltharp made following motion: I move that this Commission Approve the Certificate of Zoning Compliance request of Charles Nichols for new residential construction at 1404 Madison Street. I further move that the approval be based on the following findings of fact: • The proposed action is in conformity with the zoning requirements and intent of the Ordinance; • The proposed action is complementary to all conforming structures within the zone; • The proposed action is in conformity and complies with a majority of the NSZ Fountain Avenue Design Guidelines and Secretary of Interior Standards for Rehabilitation. No motion was made. HARC notes more information is needed for the proposed home at 1412 Madison. Case #COA2023-0012 Applicant: David & Sandra Guess Request for Certificate of Appropriateness Address: 908 Jefferson Street Planning Staff presented the staff report. Discussion between the HARC and Applicant. Chairman Jones opened the floor to Public Comment: Johanna Rhodes 333 N. 7th— No room for deviation for this case per the guidelines. Jay Downs 421 N. 7th- Everyone must follow the rules as a part of the community. Richard Glasscock 722 Harrison -There is no excuse not to follow the rules. David Guess (Applicant)1600 Eagle Cove — There are other homes in the Lowertown neighborhood/ H-2 Zone that also use vinyl windows. Victoria Terra 514 N. 7th — Previously applied for vinyl windows and was denied, the HARCs decision should remain fair and equal. Velma Phelps 514 N. 6' — Inquired about the price of vinyl vs wooden windows. Public Comment for this case was closed. Commissioner Winchester made the following motion: I move that this Commission Approve the Certificate of Appropriateness request of David and Sandra Guess for window replacement at 9o8 Jefferson Street. I further move that the approval be based on the following findings of fact • The proposed action follows the recommendations of the HARC by using an appropriate window material of either solid wood or aluminum/fiberglass clad wood, appropriate panel configuration, and appropriate use of color. The Motion was seconded by Chairman Jones and adopted with 4 Ayes (Coltharp, Johnson, Jones, Winchester) and o Nays. Case #COA2023-0013 Applicant: David & Sandra Guess Address: 302 N. 7th Street Request for Certificate of Appropriateness Planning Staff presented the staff report. Discussion between the HARC and Applicants was held. Chairman Jones opened the floor to Public Comment: Allan Rhodes 333 N. 7th— HARC needs to follow through with procedure and proper order. Others in the community follow the rules and he believes Guess/the applicant did not. Richard Glasscock 722 Harrison — Wants more proper research done on mini -split units. Public Comment forthis case was closed. Commissioner Winchester made the following motion: I move that this Commission Approve the Certificate of Appropriateness request of David and Sandra Guess fora new handrail at 302 N. 7th Street. I further move that the approval be based on the following findings of fact • The proposed handrail is complimentary to the existing rail and thereby in compliance with the H -z Lowertown Design Standards. The Motion was seconded by Commissioner Coltharp and adopted with 4 Ayes (Coltharp, Johnson, Jones, Winchester) and o Nays. Commissioner Johnson offered the following motion: I move that this Commission Approve the Certificate of Appropriateness request of David and Sandra Guess for the placement of five mini -split air units to be located on the exterior of the property at 302 N. 7`h Street. I further move that the approval be based on the following findings of fact • All visible mini -split units are to be concealed and painted to match the brick of house • All conduit and hide -a -lines will be enclosed, concealed and painted to match the brick The Motion was seconded by Commissioner Coltharp and adopted with 4 Ayes (Coltharp, Johnson, Jones, Winchester) and o Nays. Adjournment Chairman Jones made a motion to adjourn the meeting. Commissioner Johnson seconded. At the October 911' HARC meeting this case #COA2023-0012 was granted a COA allowing for the replacement of all windows with wooden or aluminum/fiberglass clad wooden windows with a panel configuration matching the original. The Applicants have continued the case to propose a combination of wooden and vinyl windows at the property. As shown in this staff a majority of the existing wooden windows located at the property have severely deteriorated. The wooden windows located on the front of the property facing Jefferson Street will remain and are not to be replaced with the proposed vinyl windows. Triple -pare plass and afoam-enhanced mainframe results in superior thermal Performance, STAFF ANALYSIS A site visit of 908 Jefferson Street conducted on October 2611, by the HARC Chairman, Planning Director, and Planning Staff determined that the windows located on the side of the property are not ordinarily visible from the roadway such that the proposed changes are "change[s] in exterior appearance" as set forth in the Code.^ne be admiRistered by the 14ARQ As defined in the City of Paducah Zoning Ordinance Sec. 126-113 (g) the definition of and requirements for a change in exterior appearance are: "(g) Certificate of Appropriateness required for changes in exterior appearance. Material change of the exterior appearance of any existing building by additional reconstruction, alteration or maintenance, including change in color, form or texture of materials. c. The term "change in exterior appearance," as used in this subsection (g), shall apply to alterations or changes which are ordinarily visible from any public roadway within an historical zone or adjacent to a landmark site, excluding alleys. d. The determination of ordinarily visible from the roadway is made by the Zoning Administrator. Appeals of the Zoning Administrators decision can be made to HARC in accordance with KRS 100.261." The location of the house on Jefferson Street is influential in this determination. At the address Jefferson Street is a one-way road. The traffic that passes the property along the roadway only has the possibility of partially seeing the windows located of the left-hand side of the property. The windows located on the right side are even less visible from the roadway as the traffic does not travel in its direction. The bay windows extending from the sides of the house also prevent normal viewing of the windows located towards the rear corners of the structure. The windows located on the sides of 908 Jefferson are not street facing unlike a property that sits on a corner lot which would contain an additional clear and ordinarily visible side. Additionally, the proposal of keeping wooden windows on the front facade and using vinyl windows on the non -street facing sides has been previously approved by HARC for other homes in the H-2 Zone. For example, case #COA2019-216 for 301 N. 6's Street. This property was approved for wooden windows to be kept on the front facade while on the non -street facing sides vinyl windows were allowed. Staff recommends this precedent be followed as it matches the proposal for 908 Jefferson. The neighboring address of the Ellis apartments located at 129/133 N. 9w Street also contain vinyl, double hung, one -over -one windows approved by the HARC dated 8/12/13. These windows are also painted to complement their primary structure. While determined as not ordinarily visible from the roadway and thereby not required to follow the H-2 Guidelines the proposal for the vinyl windows is still partially in following with their recommendation as they will be painted to complement the primary structure. In summary Staff recommends approval for the proposal because of the following: • The retention and continued use of wooden windows on the front street facing facade • The determination of the side windows not being ordinarily visible from the roadway • The precedent set by other homes using wooden windows on front and vinyl windows on sides being previously approved by HARC • Replacement of the windows is necessary due to their severe deterioration RECOMMENDED MOTIONS Based on the above, staff recommends approval of the request and recommends the following motion: I move that this Commission Approve the Certificate of Appropriateness request of David and Sandra Guess for window replacement at 908 Jefferson Street. I further move that the approval be based on the following findings of fact • The proposed vinyl windows will be not ordinarily visible from the main Jefferson Street Roadway • Wooden windows will be kept on the front street facing facade
