Sommer, Planner III; Nic Hutchison, Director of Planning Guests: Burnham & Cynthia Jones, Jason Goins, Michael Henderson, several other guests who did not speak. Chairman Wade called the regular meeting of the Paducah Planning Commission/ URCDA to order at 5:30 PM. The Pledge of Allegiance was recited. The roll was taken. Chairman Wade opened the floor for nominations for Vice-Chair. Commissioner Pollard nominated Vice-Chair Morrison. Commissioner Kaler seconded. Chairman Wade asked if there were any other nominations. Hearing none, he asked if there was a motion to cease nominations and elected Vice-Chair Morrison by acclimation. Commissioner Pollard made the motion to cease nominations and elect Vice-Chair Morrison by acclimation. Commissioner Rhodes seconded. Chairman Wade asked all in favor. 5 Ayes (Griffin, Kaler, Pollard, Rhodes, Wade) Commissioner Rhodes offered: I move that the reading of the minutes for April 3, 2023 be waived and that the minutes of said meeting, as prepared by staff, be approved as written. Commissioner Pollard seconded. Vice-Chair Morrison asked if the proposed land use for Duff Real Estate was commercial on the Future Land Use Map. Mr. Sommer stated that was correct. No corrections were requested. Chairman Wade called for the vote. 5 Ayes (Griffin, Morrison, Pollard, Rhodes, Wade), 0 Nays Note: This was Commissioner Kaler’s first meeting. URCDA New Petitions Planning Commission Continued Petitions Planning Commission New Petitions Case # ZON2023-0002 252 Locust Avenue Initial zoning request. Mr. Sommer stated this was an initial zoning request for the property to be the M-1 Light Industrial Zone. He stated 63,162 square feet of the total lot was being annexed. The M-1 Zone touches the parcel to the south. Mr. Sommer stated the Petitioner envisions a service-type establishment for the industrial developments and future apartments. Commissioner Griffin offered: I move that this Commission adopt a resolution recommending the Light Industrial Zone classification for a portion of property located at 252 Locust Avenue. I further move this Commission adopt the following findings of fact in support of said recommendation: The parcel is urban in character. Industrial zoning in both the City and McCracken County is located adjacent to the site. The M-1 Zone would provide commercial developments as a principal use, which is envisioned by the Petitioner. The M-1 Zone is located directly south of the site; therefore, this site would be a continuation of this zone. Since no other City zoning designation touches this property, an initial zone of M-1 would not create a spot zone. Commissioner Pollard seconded. Chairman Wade then opened the public hearing and invited the public to speak. No one spoke at the public hearing. Hearing no public comment, Chairman Wade closed the public hearing. Vice-Chair Morrison asked what types of land uses the M-1 Zone could accommodate. Mr. Sommer stated all residential, commercial and industrial uses could be located in this zone. No further questions were asked. Chairman Wade called for the vote. 6 Ayes (Griffin, Kaler, Morrison, Pollard, Rhodes, Wade), 0 Nays Case # PLT2023-0002 3750 Pecan Drive and 600 & 601 Deer Lick Place Preliminary subdivision plat Mr. Sommer stated the plat before the Planning Commission was intended to replace the preliminary plat approval on the same piece of property. The last plat had approximately 122 residential lots. The new plat has 12 lots. Mr. Sommer described the ROW closures proposed to be forthcoming. Staff did have some comments that Mr. Sommer described and they had been relayed to the Petitioners. Vice-Chair Morrison offered: I move that the preliminary plat approval given on February 6, 2023 for Case #APP2023-0003 be rescinded for a new preliminary plat to take precedence. I further move that the Planned Unit Development, also adopted on February 6, 2023 for Case #APP2023-0003 be rescinded as well as all proposed lots on the new preliminary plat meet the requirements of the R-1 Low Density Residential Zone. I further move that the preliminary subdivision plat for 3750 Pecan Drive and 600 & 601 Deer Lick Place be approved and that the matter be continued generally, pending submission of a final plat incorporating all requirements made known to the Petitioner at the conclusion of the hearing. Commissioner Pollard seconded. Chairman Wade then opened the public hearing. Mr. Michael Henderson stated his mother lives on Hill Terrace. He asked if any trees would be left on Hill Terrace and if driveways would enter off Hill Terrace. Mr. Jason Goins stated there would be a limited number of driveways off Hill Terrace and described how the lots would be served. Mr. Burnham Jones, new owner and petitioner, (5775 Blandville Road) stated the plat would have the restrictions in place regarding how many and what size trees could be removed. Mr. Henderson asked about the placement of the detention pond. Mr. Jones stated there would be a pond across from Mr. Howell’s property. Commissioner Kaler stated the property contains dogwood trees and she was glad they were being saved. Upon not hearing any further public comment, Chairman Wade closed the public hearing and called for the vote. 6 Ayes (Griffin, Kaler, Morrison, Pollard, Rhodes, Wade), 0 Nays Case # VAC2023-0003 100 Vermont Street ROW closure of Vermont Street. Mr. Sommer stated this petition had been requested to be tabled. Further engineering work needed to be done for City requirements. Commissioner Pollard offered: I move that this Commission open the public hearing for Case# VAC2023-0003 pertaining to a right-of-way closure between 100 Vermont Street and 125 Ridgeview Street. I further move that this item be tabled generally, pending approval of the necessary requirements being satisfactory to pertinent City departments. Commissioner Rhodes seconded. Chairman Wade then opened the public hearing. No one spoke at the public hearing. Hearing no public comment, Chairman Wade closed the public hearing. No further questions were asked. Chairman Wade called for the vote. 6 Ayes (Griffin, Kaler, Morrison, Pollard, Rhodes, Wade), 0 Nays Other Business Mr. Sommer stated that Duff Real Estate has retained an attorney in Paducah.
