AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE
DOCUMENTS TO -RELEASE EAGLE PROPERTIES a CONSTRUCTION INC.
FROM STREETSCAPE PROJECT - PHASE I
WHEREAS, by Ordinance No. 99-9-6115 the City of Paducah
approved a contract in the amount of $845,849.36 with Eagle Properties and
Construction Inc. for the Streetscape Project — Phase I; and
WHEREAS, circumstances have arisen resulting in both the City and
Contractor wishing to mutually release one another from the Streetscape Project —
Phase I; and
WHEREAS, Change Order No. 1 is required to decrease the contract
amount by $368,692.49, and to release Eagle from the remainder of this contract.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized to execute
Change Order No. 1 for a decrease in the contract in the amount of $368,692.49
with Eagle Properties and Construction Inc., thereby decreasing the total contract
amount to $477,156.87 for work performed on the Streetscape Project — Phase I.
SECTION 2. The Mayor is further authorized to execute a Mutual
Release Agreement with Eagle Properties and Construction Inc. to release Eagle
from their contract on the project in Section 1 above.
SECTION 3. This adjustment shall be applied to Account No. 040-
1203-513-2307.
SECTION 4. In order to provide continuity for the completion of
this project, an emergency is hereby declared to exist and this ordinance shall
become effective immediately with one reading.
