ORDINANCE 2003-11-6715
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE CHANGE ORDER #1 WITH JIM SMITH CONTRACTING CO., INC., FOR
THE CITY OF PADUCAH'S 2003 STREET RESURFACING PROGRAM
WHEREAS, it has been made financially possible for the City to implement
rehabilitation of the existing infrastructure in Lowertown through grant sources available
through the Paducah Area Transit System; and
WHEREAS, the City approved Ordinance No. 2002-3-6643 to enter into a
contract with Jim Smith Contracting Co., Inc., in the amount of $1,087,995.00 for the City of
Paducah's 2003 Street Resurfacing Program and established the completion date as
December 31, 2003; and
WHEREAS, Change Order No. 1 in the amount of $320,000, is required to
complete the Lowertown Infrastructure Improvement project, increasing the total contract
amount to $1,407,995.00; and
WHEREAS, due to this additional work, the time for completion of the
original contract has been extended from December 31, 2003 to March 1, 2004.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized and directed to execute Change
Order No. 1 for the City of Paducah's 2003 Street Resurfacing Program for an increase in the
amount of $320,000.00 with Jim Smith Contracting, Co., Inc., to complete the Lowertown
Infrastructure Improvement project, increasing the total cost to $1,407,995.00 and extending
the time period from December 31, 2003 to March 1, 2004.
SECTION 2. This expenditure shall be charged to the Engineering
Department — Street Resurfacing and Rehab account.
SECTION 3. In order to receive funding from grant sources available through
the Paducah Area Transit System and contractural time constraints, an emergency is hereby
declared to exist and this ordinance shall become effective immediately.
