HomeMy WebLinkAbout2003-8-6669531 ORDINANCE NO. 2003-8-6669 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FROM R-4, HIGH DENSITY RESIDENTIAL ZONE, TO B-1, CONVENIENCE & SERVICE ZONE, FOR PROPERTY LOCATED AT 3127, 3130, 3131 & 3140 PARISA DRIVE, AND AMENDING THE PADUCAH ZONING i ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on July 7, 2003, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE ZONING CHANGE FROM R-4 TO B-1 FOR PROPERTY LOCATED AT 3127, 3130, 3131 & 3140 PARISA DRIVE" be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from R-4, High Density Residential Zone to B-1, Convenience & Service Zone: Beginning at a point in the centerline of Parisa drive and the south right-of-way of Jackson Street; thence South 28 degrees 09 minutes 30 seconds East for a distance of 243.22 feet with the centerline of Parisa Drive to a point in said road; thence along a curve to the right having a T radius of 549.10 feet an arc length of 124.03 feet, being subtended by a chord of South 72 degrees 02 minutes 11 seconds West for a distance of 123.76 feet along said drive to a point; thence South 78 degrees 30 minutes 26 seconds West for a distance of 58.90 feet with said road to a point; thence along a curve to the left having a radius Of 600.00 feet and an arc length of 58.37 feet being subtended by a chord of South 75 degrees 43 minutes 14 seconds West for a distance of 58.34 feet with said drive to a point; thence South 17 degrees 03 minutes 59 seconds East for a distance of 25.00 feet to the northwest corner of lot 4 of Executive Park Plaza; thence South 04 degrees 45 minutes 05 seconds East for a distance of 195.30 feet to the southwest corner of lot 4; thence North 89 degrees 40 minutes 56 seconds East for a distance of 174.20 feet with the south line of lot 4 and a portion of the south line of lot 3 to a point; thence North 15 degrees 51 minutes 20 seconds East for a distance of 117.20 feet with the east line of lot 3 to a point; thence North 16 degrees 26 minutes 12 seconds East for a distance of 308.77 feet continuing with the east line of lot 3 to a point; thence North 37 degrees 53 minutes 44 seconds East for a distance of 232.54 feet to the southeast corner of lot 1 of said subdivision; thence North 28 degrees 48 minutes 21 seconds West for a distance of 244.87 feet with the east line of lot 1 to a point on the south right-of-way of Jackson Street; thence with the south right of way of Jackson Street the following (3) courses; South 58 degrees 25 minutes 00 seconds West for a distance of 141.48 feet to a point; South 59 degrees 44 minutes 48 seconds West for a distance of 120.76 feet to a point; South 61 degrees 34 minutes 03 seconds West for a distance of 101.61 feet to the point of beginning; Said property contains 4.6816 acres more or less. 532 SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate Pays and will become effective upon summary publication pursuant to KRS Ch 4 Mayor ATTEST: �7Acm, Tammara S.
