AN ORDINANCE AUTHORIZING THE ASSIGNMENT
OF AN ENCROACHMENT AGREEMENT BY LONG
CONCRETE INDUSTRIES, INC., TO LONG BLOCK &
(' BRICK, LLC
WHEREAS, Long Concrete Industries, Inc., did sell and convey unto Long
Block & Brick, LLC all of its assets, including its real and personal properties; and
WHEREAS, as part of the sale transaction, Long Concrete Industries, Inc.,
did assign and set over to Long Block & Brick, LLC an encroachment agreement executed on
June 29, 1998, by and between the City of Paducah, Kentucky, and Long Concrete Industries,
Inc., and all of its rights, privileges, and obligations thereunder; and
WHEREAS, pursuant to paragraph 8 of said agreement, Long Concrete
Industries, Inc., could not assign or convey the encroachment agreement, or any right,
privilege or obligation thereunder, without the prior written consent of the City; and
WHEREAS, Long Concrete Industries, Inc., and Long Block & Brick, LLC
did jointly request the approval of such assignment, and the City having no objection to such
assignment; and
WHEREAS, Long Block & Brick, LLC has represented to the City that it
intends to use the rights and privileges under said agreement in a manner consistent with Long
Concrete Industries' present use.
NOW, BE IT ORDAINED, by the City of Paducah, Kentucky, as follows:
Section 1. The City Commission does hereby approve the assignment of the
encroachment agreement executed by and between the City of Paducah and Long Concrete
Industries, Inc., dated June 29, 1998, by Long Concrete Industries, Inc., to Long Block &
Brick, LLC. This approval of assignment is made by reason of the representation made by
Long Block & Brick, LLC that it intends to use the rights and privileges of Long Concrete
Industries, Inc., under the encroachment agreement in a manner consistent with the prior use
by Long Concrete Industries, Inc.
