AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A
SETTLEMENT AGREEMENT WITH KENTUCKY OAKS MALL COMPANY FOR
ACQUISITION OF RIGHT OF WAY FOR JORDAN DRIVE
WHEREAS, the City of Paducah has deemed it necessary to acquire certain
real property to permit construction of the continuation of Jordan Drive which runs between
ems. Sanders Boulevard and Kentucky Oaks Mall Company properties; and
WHEREAS, Kentucky Oaks Mall Company has agreed to donate, in lieu of
condemnation, the necessary right of way to enable the City to proceed with the construction
of Jordan Drive. Kentucky Oaks Mall Company has further agreed to permit the City to
make related improvements on part of the Kentucky Oaks Mall Company property as
associated with the Jordan Drive road improvements.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Board of Commissioners hereby approves the Settlement
Agreement and Release of Claims between the City of Paducah and Kentucky Oaks Mall
Company for the establishment of the continuation of Jordan Drive. In such regard, the Mayor is
hereby authorized to execute the Settlement Agreement and Release of Claims for and on behalf
of the City of Paducah.
SECTION 2. The Mayor is hereby authorized to execute a Quitclaim Deed and
all documents necessary for the acquisition of right-of-way from Kentucky Oaks Mall Company
for the establishment of Jordan Drive.
SECTION 3. This Ordinance shall be read on two separate days and will be
effective upon summary publication pursuant to KRS
