HomeMy WebLinkAbout2003-12-6727613 ORDINANCE NO. 2003-12-6727 AN ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, a tract of properties adjacent to the present city limits, located adjacent to U.S. Highway 62, is urban in character and suitable for development for urban purposes without unreasonable delay; and WHEREAS, the property is contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property; and WHEREAS, said tract of land is not within the boundary of another incorporated city; and WHEREAS, the owners have requested such annexation in writing to the Mayor and Board of Commissioners of the City of Paducah. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to finalize the awexatio* of the hereinafter described property, and therefore that the hereinafter described property be annexed to, and made a part of the City of Paducah, Kentucky; said real property being more particularly and accurately described as follows: Lying along U. S. Highway 62 (Blandville Road) and being part of the Southerly right-of-way of said U. S. Highway 62 and part of the°CHD Group LLC property recorded in Deed Book 989, Page 319, McCracken County Court Clerk's Office, McCracken County, Kentucky, and more particularly bounded and described as follows to wit: Beginning at a point in the Southerly Corporate City Limit Line to the City of Paducah and the original Southerly right-of-way line of U. S. Highway 62 (Blandville Road) at its intersection with the Easterly line, projected Northeastwardly, of the CHD Group LLC property per Deed Book 989, Page 319, as shown on "Plat of Survey for Churchwell, Davis and Hickey of the Helen Marie Krimple Estate" dated June 28, 2002; THENCE FROM SAID POINT OF BEGINNING S 220 50' 17" W with the Easterly line, projected Northeastwardly, of said CHD Group LLC property to an existing '/2 inch rebar with Cap No. 2105 in the existing Southerly right-of-way line of said U. S. Highway 62 at the Northeasterly corner thereof, said point also being at the Northwesterly corner of Tract 1 per Waiver of Subdivision recorded in Plat Section "L', Page 189; thence S 220 50' 17" W with the Westerly line of said Tract 1 and the Westerly line of Tract 2, per said Waiver of Subdivision recorded in Plat Section "L", Page 189, 691.98 feet to an existing '/2 inch rebar with Cap No. 2105 at the Southwesterly corner of said Tract 2 and in the Northerly line of Highlands Subdivision recorded in Plat Section "L', Page 802; thence N 690 04' 37" W with the Northerly line of said Highlands Subdivision 396.35 feet to an existing 5/16" iron pin at the Northwesterly corner thereof; thence S 230 21' 26" W with the Westerly line of said Highlands Subdivision 1,096.38 feet to an existing 6" x 6" stone witnessed with a'/2 inch rebar with Cap No. 2105 at the Southwesterly corner thereof and in the Northerly line of the Donald and Nancy Bruce property per Deed Book 459, Page 601; thence N 680 04' 18" W with the Northerly line of said Bruce property 408.92 feet to a'/2 inch rebar with Cap No. 2105; thence N 230 21' 26" E, 512.37 feet to a'/z inch rebar with Cap No. 2105; thence N 70 34' 57W, 80.00 feet to a'/2 inch rebar with Cap No. 2105; thence S �• 8202503" W, 197.00 feet to a'/2 inch rebar with Cap No. 2105; thence N 70 34' 57" W, 100.00 feet to a 4 inch diameter concrete monument with Cap No. 2105 at the beginning of a curve to the right, having a radius of 20.00 feet; thence Northeastwardly with said curve to the right (a chord being N 370 25' 03" E, 28.28 feet) 31.42 feet to a 4 inch diameter concrete monument with Cap No. 2105 at the end of said curve; thence S 820 25' 03" W, 65.00 feet to a point; thence N 70 34' 57" W, 45.90 feet to a point at the beginning of a curve to the left, having a radius of 161.60 feet; thence Northwestwardly with said curve to the left (a chord being N 220 34' 57" W, 83.65 feet) 84.61 feet to a 4 inch diameter concrete monument with Cap No. 2105 at the end of said curve and beginning of a curve to the right having a radius of 111.60 feet; thence Northwestwardly with said curve to the right (a chord being N 70 34'57" W, 111.60 feet) 116.87 feet to a 4 inch diameter concrete monument with Cap No. 2105 at the end of said curve and at the beginning of a curve to 614 the left, having a radius of 161.60 feet; thence Northeastwardly with said curve to the left (a chord being N 70 25' 03" E, 83.65 feet) 84.61 feet to a 4 inch diameter concrete monument with Cap No. 2105 set at the end of said curve; thence N 70 34' 57" W, 160.90 feet to a 4 inch diameter concrete monument with Cap No. 2105 at the beginning of a curve to the left, having a radius of 35.00 feet; thence Northwestwardly with said curve to the left (a chord being N 520 34' 57" W, 49.50 feet) 54.98 feet to a 4 inch diameter concrete monument with Cap No. 2105 at the end of said curve and in the Southerly right-of-way line of aforesaid U. S. Highway 62 (Blandville Road); thence N 70 34' 57" W to a point in the aforesaid original Southerly right-of-way line of said U. S. Highway 62 (30 feet from the centerline thereof) and the Southerly Corporate City Limit Line to the City of Paducah per Ordinance No. 83-3-2362; thence Northeastwardly with said original Southerly right-of-way line of U. S. Highway 62 and said Southerly Corporate City Limit Line to the City of Paducah per Ordinance No. 83-3-2362 to the point of beginning and containing approximately 28.5 acres, as shown on "Annexation Plat for CHD Group LLC" prepared by Hunter Martin & Associates, Inc. dated December 4, 2003. The above legal description was written by Rod H. Martin, Kentucky Licensed Professional Land Surveyor, on the 4t" day of December. 2003, and is correct to the best of my knowledge and belief.
